Slippers or other Wares laft particularized, either before or after the fame (hall be refpectively fo made into Wares, and be thereof lawfully convicted upon the Oath or Affirmation of the Matter or Owner 01 fuch Goods or Wares, or any other credible Witnefs or WitnefTes, or by the Confeffion of the Perfon or Perfons charged with the Fact, before one or more Juftice or Juftices of the Peace for the County Riding, Divifion, City, Town or Place, where fuch Offence (hall be committed, or where the Party or Parties fo charged (hall refide or inhabit (which Oath or Affirmation fuch Juftice or Juftices is and are hereby impowered to adminifter and take) fuch Juftice or Juftices lhall and may award the Perfon or Perfons fo offending, to make a reafonable and fuitable Recompence and Satisfaction for every Offence to the Parties reflectively injured, for the Damage by them fuftained, fo as the fame do not exceed double the Value of the Gloves, Breeches, Leather, Boots, Shoes, Slippers, Wares, Goods or Mate- rials, by fuch Offender or Offenders fo purloined or embeziled, fecretecl, fold, pawned or exchanged • one Half thereof to go to the Party or Parties grieved, and the other Plalf thereof to go and be applied to the Ufe of the Poor of the Parilh or Place where fuch Offence lhall be committed, together with the full Charges attending fuch Conviction, to be levied by Warrant under the Hand and Seal or Hands and Seals of fuch Juftice or Juftices by Diftrefs and Sale of the Offenders Goods, rendering the Overplus J?ff be j evied °" u P on Demand to the Owner ; but if fuch Offender or Offenders (hall not have Goods fufficient to an- Goods" S f wer f° r levying the Forfeitures and the Expences and Charges attending the Premifles, and (hall alio neglect or refufe immediately to pay the fame, that then the laid Offender and Offenders (hall, by like Warrant of fuch Juftice or Juftices laft defcribed, be, for every diftinit Offence,, committed to the Houfe of Correction, or other publick Prifon of fuch County, Riding, City, Town or Place, and there kept to hard Labour for the Space of fourteen Days, and (hall be there likewife whipped in fuch Manner as the faid Juftice or Juftices (hall order and direct ; and in cafe alfo of a fubfequent Conviction for or on a fecond or any other fuch like Offence, the Perfon or Perfons fo offending for every fecond or other fubfequent Offence, being thereof convicted in manner before-mentioned, (hall forfeit four Times the Value of the Damages which the Owner or Owners of fuch Materials, either before or after the fame (hall be reflectively made up into Wares, (hall fuftain thereby, together with fuch Cofts of Profecution as (hall be adjudged reafonable by the Juftice before whom fuch Offender or Offenders (hall be thereof refpectively convicted ; and in cafe immediate Payment of the refpective Forfeitures, together with fuch Cofts of Profecution as aforefaid, (hall be neglected or refufed to be made, that then it (hall and maybe lawful to and for fuch Juftice to commit the Offender or Offenders laft defcribed to the Houfe of Cor- Monthffr lefe P re<5tion, or other publick Prifon, to be there kept to hard Labour for any Time not exceeding three than one; ' Months, n or lefs than one Month, as to fuch Juftice (hall feem reafonable ; and alfo during the Time and be publick- f f ucn Offender or Offenders refpective Commitment or Commitments, (hall caufe the faid Offendei or Offenders to be publickly whipped in the Market Town where fuch Offender or Offenders (hall be refpectively committed, at the Market Place or Crofs of fuch Town, once or oftner as to fuch Juftics (hall feem reafonable. V. And be it further enacted by the Authority aforefaid, That every Perfon and Perfons who (ha[ jea to the fame knowingly or willingly, from and after the faid firft Day of May one thoufand feven hundred and forty. Penalties. buy or receive, accept or take, by way of Pawn, Pledge or Sale, or in any other Manner, of or from any or either of the Perfons offending in either of the Particulars in this Act laft mentioned, or of 01 from any other Perfon or Perfons whatfoever (except of or from the Perfon or Perfons in whom the Pro- perty of fuch Gloves, Breeches, Leather, Boots, Shoes, Slippers, Wares, Goods or other Materials (hall be at the Time of fuch Sale, Pawn, or Exchange) or offer fo to do, fuch Perfon or Perfons of- fending therein refpectively, (hall, for every Offence, being convicted thereof in Manner aforefaid, mak< fuch fuitable and reafonable Recompence and Satisfaction within two Days next after the Matter of Fa<51 (hall from time to time be determined by any one or more Juftice or Juftices as aforefaid, upon hearinj the fame (he and they being hereby in this Refpect alfo impowered fo to do) or elfe be fubjeit to fuch Di- ftrefs, and for want of fufficient Diftrefs to be liable to the like Puniihment as is hereby directed to bt inflicted on fuch Perfon or Perfons as (hall purloin, imbezil, fecrete, fell, pawn or exchange any Gloves Breeches, Leather, Boots, Shoes, Slippers, Wares, Goods or other Materials or Effects of that Sort a: aforefaid, and fo in like Manner for any fecond and every other fubfequent Offence. VI. And to prevent OppreiTion of the Labourers and Workmen employed in any refpect in or abou making or manufadturing of Gloves, Breeches, Boots, Shoes, Slippers, Wares or Goods of that Sor before-mentioned; Be it enacted by the Authority aforefaid, That from and after the faid firft Day o May one thoufand feven hundred and forty, all Payments and Satisfaction hereafter to be made to an; fuch Labourers, Manufacturers and Workmen, employed as aforefaid, for any Work by them done ii and about fuch Manufactures, (hall be in and of the lawful Coin of this Realm only, and not by an; Victuals, Goods or Commodities whatfoever, in lieu thereof (except at and by his and their Requel and Confent only) j and all Goods and Materials delivered out to be wrought up in the Manufacture lal mentioned, (hall be delivered with a Declaration at the fame Time, of the true Weight, Quantity o Tale thereof, on Pain that every Offender in either of the faid Cafes (hall forfeit and pay to fuch La bourer, Manufacturer or Worker, double the Value of what (hall be due for fuch Work by him, her o them done and performed ; and if any fuch Labourer, Manufacturer or Worker, as is laft defcribed (hall be guilty of any Fraud, Abufe, Neglect or Default in the Work by him, her or them undertakei to be done, then fuch Labourer, Manufacturer or Worker (hall allow and anfwer to the Owner ot fuel Work double the Damages thereby fuftained. VII. And be it further enacted by the Authority aforefaid, That all Wages, Demands, Frauds, Abufe; Neglects and Defaults of Labourers, Manufacturers and Workmen in the Trades laft above-mention one half to the Sufferer, the other to the Poor of the Parifh ; or fent to the Houfe of Cor- rection for a Fortnight, and there whipp'd ; and for any fubfequent Of- fence to forfeit four Times the Value. or fent to the Houfe of Cor. reftion not ly whipp'd.
