And whereas the making and maintaining the Outring Banks in the faid fifth Diftri£l-, will be Allowance to be of Utility to the Lands in the faid fourth Diftrict ; Be it therefore enafted by the Authority aforefaid, made from tha That the CommilTioners for the faid fourth Diftri6l fliall, and they are hereby required to pay, or caufe ^'h to the 5th to be paid, to the Commifiioners for the faid fifth Diltridl:, or to fuch Perfon or Perfons as they fhall I^'^"^' appoint, the Sum of twenty Shillings in every Year, for and in Confideration of their making and main- taining the faid Banks ; the firft of which Payments fliall be made on or before the twenty-fourth Day oi June one thoufand feven hundred and fifty-eight ; and fuch Payments fhall continue to be made on or before fuch Day in every fucceeding Year. XLV. And be it further ena£ted by the Authority aforefaid. That if any Perfon or Perfons whatfoever, Perfons <J;!m3- at any Time or Times hereafter, fliall wilfully or malicioufly cut, or otherwife damage, any of the Banks, ging the Works, Works, Mills or Engines, already made or ereited, or which fliall at any Time hereafter be making or erefting, or made or erefted, fupported or maintained, for anfwering any of the Purpofes of this A6t, or by any Means obftru61:, divert or lay open, any of the Banks, Cuts, Drains, Dams, Outlets, or other Works made, or which fhall at any Time hereafter be making or made, fupported or maintained, for draining or improving the faid Fen Lands or Low Grounds in purfuance of this A6f, and Ihall be con- victed thereof, upon Oath, before any tv^o or more Juflices of the Peace for the County or Place v/hercin the Offence fhall be committed, or the Offender fhall refide ; every fuch Perfon or Perfons fhall forfeit to forfeit 100 2; for every fuch Offence the Sum of one hundred Pounds, to be levied by Didrefs and Sale of the Goods and Chattels of fuch Offender or Offenders, by Warrant under the Hands and Seals of any two of the Juftices before whom fuch Convi6tion fliall be made, to be applied and laid out in carrying on the Works, and executing the Purpofes of this A6f, within the refpeftive Diftridt, wherein or in relation •^'hereunto, the Offence fliall he committed ; and for want of fufficient Difl^refs, fuch Offender and Of- and for want of fenders fliall by the faid Juflices be committed to the Common Gaol of fuch County or Place, there Diftrel's, to be to remain for any Time not exceeding twelve Calendar Months, without Bail or Mainprize, at the *^"^'^^^*' Difcretion of the faid Juftices ; and fhall alfo make full Compenfation and Satisfaction to ail and every Perfon and Perfons who fhall be injured thereby, for the Damage fuch Perfon or Perfons fhall thereby fuftain; which Compenfation and Satisfaction fhall be recovered, together with full Cofts of Suit, in fuch Manner as is herein before prefcribed for the Recovery of Damages fuftained by the Working of any Horfe Mill, or other Device: And if any Perfon or Perfons fhall wilfully and malicioufly fet fire to, pg^f^j^^ ^^^^ burn, or otherwife deftroy, any of the faid Mills or Engines already made or ereCled, or which fliall be ing Mills, &cT" making or erecting, or made or ereCled, fupported or maintained, for anfwering any of the Purpofes of this Aft, and be thereof lawfully conviCted, fuch Perfon or Perfons fliall be adjudged guilty of Felony, to fdffcr as Fs- and fhall be fubject and liable to the like Pains and Penalties as in any other Cafes of Felony ; and the lo"s. Court by or before whom fuch Perfon or Perfons fhall be tried, fliall, and have hereby Power and Au- thority to tranfport refpeclively fuch Felons for feven Years, in like Manner as other Felons are direCted to be tranfported by the Laws and Statutes of this Realm.
