Certain Pcrfcns app'^intC'l Ci-m- mirtioocr', with oiiiert, »o be ehofen for the fcveral Place?, of fuch Lands from Taxes, ihe fame fhall be determined upon View within four Months after pafTingthis A61, by nine or more of t!ie faid CommifBoners no ^tlys interelled in the Property of the Lands in qcre- fHon ; and all fuch Commiifioiicry, before they proceed to determine fuch Difputes, fliall taice an Oath well and truly, to the beft of their Judgment, to determine whether fuch Lands ought, or ought not to be ex- empted from Taxes ; which Oath any one or more of the Commiflioners are hereby im.powered to admini- fter ; and fuch Commiflioners (liall fet forth their Determination in two difiincl Writings, and fball fign the fame ; and one of fuch Writings fliall be delivered to the Owner or Owners of fuch Lands, and the other o£L fuch Writings fhall be depofited in the Pari{h Church of the Holy Trinity in Et'y. XL. And be it further ena6led, That if any A6lion, Suit or Information, fhall be commenced or pro- fecuted againfl: any Perfon or Perfons, for any thing done or to be done in purfuance of this A£l, and in the Execution of any of the Powers and Authorities hereby gii'en, every fuch Action or Suit (hall be com- menced within fix Calendar Months next after the Fact committed ; and fhall be laid or brought in the Court of Pleas of the faid Ifle o^ Ely^ or in the faid County of Civnhridge, and not clfewhere ; and the De- fendant or Defendants in fuch Adfion or Suit fnall and may plead the General liTue, and if in Replevin, may juflify and avow, by virtue of this A61, as Perfons ai;:iing by Authority of CommifFioners of Sev/ers are enabled to do; and may give this A6t, and the Special Matter, iii Evidence, without fpecially pleading the fame, otherwife than as aforefaid, at any Trial to be had thereupon, and that the Fa£t alledged in fuch. A6tion or Suit to have been done, was done in purfuance, and by the Authority of this A6t ; and if the fame fhall appear to have been fo done, or if fuch Adiion or Suit fhall be brought after the Time before li- mited for bringing the fame, or fhall be brought in any other County or Place than as aforeiaid, then the Jury fhall find for the Defendant or Defendants, Avowant or Avowants ; or if the Plaintiff or Plaintiffs fhall become nonfuit, or forbear Profecution, or difcontinue his, her or their Suit or Suits; or if any Judg- ment fhall be given againfl him, her or them, upon a Demurrer or otherwife ; then, or in any of the faid Cafes, the Defendant or Defendants, Avowant or Avov/ants, fhall recover Treble Cofls, for which he, fhe or they fhall have like Remedy as where Coffs by Law are awarded. XLI. And be it further enacted and declared. That this A61 fhall be deemed and allowed to be a Publick Aft ; and all Judges, Jufliccs and other Perfons, are hereby required to take Notice thereof as fuch, with- out fpecially pleading the fame. C A P. XIX. An A eft for draining and preferving certain Fen Land?, Low Grounds and Commons, in the Parifhes oi Chatteris and Boddington^ in the Ifle of E[) m the County oi Cambri'ge. WHEREAS certain Fen Lands, Low Grounds and Commons, lying and being in the Pariflies of Chatteris znd Doddington^ within the Ifle of ^/y, in the County of Cambridge.^ containing in the Whole two thoufand two hundred and fifty Acres, or thereabouts, and which are bounded and defcribed as follows ; (that is to fay) From Slade-Bridge, by the Weft Side of the Drain called Wirnblington-leaniy or the Ttventy-fooi^ to the Drain called Vermuydens Drain^ or the Forty-foot at Gorexvillow; and from thence by the South Side of the faid Forty-foot^ to Garter's Bridge and from thence by the Hard Lands of Curf and Gore Common^ to Slade-hridge again ; and from thence by the Eaft Side of the faid IVimbling- ton-leam^ to the faid Forty foot at Gorcivillow ; and from thence on the South Side of the faid Forty foot^ to Langivood Hill^ ncAV Horfeway, and fo by the Hard Lands on the Weft Side oi Longvjood Hill^ and by the Hard Lands, round Hick's-Mar-Fcn, Birch-Fen^ Del/Jit'Id -And Northo^ and the Hard Lands, to S lade- bridge; and all the Low Lands and Grounds lying within fuch Boundaries, containing, by Eftimation, one thoufand two hundred Acres, or threabouts ; which faid Lands and Grounds may be conveniently, and are therefore herein after, made the firfl Diftrift of the Lands, Grounds and Commons, intended by this A6t to be drained and preferved; and alfo all thofe L^nds and Groimds bounded and defcribed as fol- lows (that is to fay) From Garter s Brid^^, by or along the Bank on the North Side of the faid Drain call- ed Fermvydens, or the Forty-foot^ to Wimblington-lcam aforefaid ; and along the North Wefl Side of the {■?d~Leam^ to the Turf-Fen and acrofs the laid Turf-Fcn^ to the South Weft Corner of the Low Lands belonging to Sir Thomas Peyton Baronet ; and from thence by JVccl Bank^ to a Piece of Land called Low Brakeny ; and by Loiu Brakeny^ to Woodlcy Grove; and by the Hard Lznds of lyood/ey Grove, including the Low Lands of IVoodley Grove^ to the South Eaft Corner of the Town- Land called Jfrotv Piece; and from thence by the North Side o( Ea/iaH- Moor, to the Twf-Fen- Lane; and from thence by the Hard Lands oi Underbills and Gents-Piece, to the common Highway ; and by the common HighAvay to Garter s Bridge; and all the Low Lands and Grounds lying within fuch Boundaries, containing, by Eflimation, one thoufand and fifty Acres, or thereabouts; which faid Lands ; nd Grounds may be conv.nicntly, and are therefore herein after, made the fecond Diftrift of the Lands, Grounds and Commons, hereby in- tended to be drained and preferved;' iVIay it therefore pleafe your Majefty, that it may be enadted; and be it enacted by the King's moft Excellent iVLajefty, by and with the Advice and Confent of the Lords Spi- ritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame. That the faid Fen Lands, Low Grounds and Commons, fhall be, and are hereby divided int;^ two Diflrifts, in fuch and the fame Manner as the fame are herein before fet forth, bounded and defcribed, and fhall be called and known by the Names oi The Firji and Second Diflri5ls; in fuch Manner as is herein be- fore particularly mentioned. II. And be; it further enacted by the Authority aforefaid. That the Lord or Lords, Lady or Ladies, for the time being, of the feveral and rcfneftive Manors oi Doddington, with the Members, Chatteris, Chatteris- Ramfcy, Chatteris Nuns, Tindalls and Lifles, and Bnrtles lately Gardner's, or in his or their Abfence, an Agent appointed by fuch J>ord or Lords, Lady or Ladies, under his, her or their Hnid or Hands, for each IVK:mber rcfpc(5lively, the RcQior of Doddington (or the tiin«; being, and the Vicai of Chatteris for the time 3 being i
