Penalty on Offi. XXI. And be it further enaded by the Authority aforefaid, That if either of the faid Clerks of the faid cers taking other Court, or any future Clerk for the time being, or the faid Beadle for the time being, or either of them. Fees, or miile- f}iall take or demand any greater or other Fee or Fees than are before mentioned, or otherwife mifbehave himfelf or themfelves in the Execution of his or their Office, that then upon Complaint made of the faid Offence or Offences to the faid Coinmiflioners, or any three or more of them, at fome Court to be held within one Month after fuch Offence or Offences fliall be committed (fuch Complaint being duly proved upon the Oath or Oaths of one or more credible Witnefs or Witneffes, againfl him or them fo offending as aforefaid) the faid CommilTioners, or any three or more of them, before whom fuch Complaint fliall be brought, fhall proceed to punifli fuch Perfon or Perfons fo offending as aforefaid, by Fine, not exceeding the Sum of five Pounds, and not lefs than forty Shillings for any one Offence, to be levied (if not paid on Demand) by Diftrefs and Sale of the Goods and Chatties of the Offender or Offenders, by Warrant under, the Hands and Seals of fuch Commiffioners, or any three or more of them, by whom fuch Complaint fliall be heard, rendering to the Owner the Overplus, if any, after the Charges of fuch Diftrefs and Sale arc de- ducted j which faid Fine or Fines of fuch Perfon or Perfons fo offending, when fo paid or levied, fhall be applied to and for the Ufe of the Poor of the Parifti where the Offence fhall have been committed. XXII. And be it further enaifed by the Authority aforefaid. That if it fhall appear to the faid Commif- fioners, or the major Part of them, that fuch Complaint defervcs the Confideration of the whole Number of Commiffioners, then fuch Commiflioners fitting in Court are hereby dire£led and required to caufe the whole Number of Commifhoners to be fummoned to meet, as foon as conveniently may be, by publick Notice to be given in the fcvcral and refpe6tive Parifli Churches, within the faid Weftern Divifion of the; Hundred oi Brixton-, by the Clerk of the Parifh, immediately after Divine Service, on the Sumlay Morning next before fuch Meeting is to be held, fuch Swiday being at leaft three Days before the holding of fuch Meet- ing, which Notice fuch Parifh Clerks are hereby required then to publifh and read, and fuch Commiflioners fo alfemblcd fliall examine into the A'lerits of fuch Complaint •, and if it fhall then appear unto fuch Com- miffioners, or the major Part of them, that fuch Clerks or Clerk, or Beadle, hath been guilty of a grofs Mifoehaviour, or Breach of Duty in his Office, that then it fhall and may be lawful to and for the faid Commiffioncrs, or the major Part of them, to fufpend or remove fuch Clerks or Clerk, or Beadle, from his or their refpedtive Office or Offices. XXI.'I. And for continuing a fufficient Number of fit, able and fubflantial Perfons to be Commiffioners for putting in Execution the Powers in this A6t contained ; Be it further ena£ted by the Authority aforefaid, Ti-rc and Place 7'hat the Commiffioncrs for the time being, fliall meet upon the firfl Day of yuly in every fucceeding Year, of Commiirion- unlefs it fliall happen to be on a Sunday^ and then on the next Day following, in fome convenient Place to be
