General Quarter- Seflions fhall have Power, from Time to Time, to raife Monies upon the refpec- Purpofes bow tobs live Counties or Ridings in fuch Manner as they now raife Monies for building or repairing "'^'^ County Gaols and Bridges, to fatisfy the faid extraordinary Charge of Carriages. XXIX. Provided always, and be it further ena6ted. That no Waggon, Wain, Cart or Carriage, No Waggon, &c. to jmpreflcd by Authority of this AcSl:, fhall be liable or obliged, by virtue of this A6V, to carry above "fry above 20 Hun^rei twenty Hundred Weight; any Thing in this ASl contained to the contrary notwithftanding. And be it further enaded, That the Carriages for the Service of the Marine Forces quar- Carriage in Scotl3n4 tered or marching in Scotland^ fhall be provided in like Manner, and at the Rates, and the Furnifber how to beprovide4. of fuch Carriages fhall be paid, as was diredfed by the Law in Force in Scotland at the Time of the Union, with regard to the furnifhing Carriages for Land Forces. XXXI. And be it enabled by the Authority aforefaid. That if any Officer, Military or Civil, by Marines Wires, &c. not this ASi authorized to quarter Marines in any Houfes hereby appointed for that Purpofe, fhall at to be quartered witbctti any Time, during the Continuance of this A^, quarter any of the Wives, Children, Men or Maid- Confent, fervants of any Officer or Marine in any fuch Houfes, againft the Confent of the Owners ; the Party offending, if an Officer of the Marines, fliall, upon Complaint and Proof thereof made to the Penaitjr, Commiflioners for executing the Office of Lord High Admiral, or Judge Advocate, be ipfo fa£lo cafliiered ; and if a Conflable, Tythingman or other Civil Officer, he fhall forfeit to the Party ag- grieved twenty Shillings, upon Complaint and Proof thereof made to the next Juflice of the Peace, to be levied by Warrant of fuch Juflice, by Diftrefs and Sale of his Goods, rendering the Overplus to the Party, after deducing reaionable Charges in taking the fame.

  • XXXII. And for the better Prefervation of the Game, in or near fuch Place where any Officers Penalty on Officers or
  • or Soldiers fliall at any Time be quartered;' Be it enacted by the Authority aforefaid, That if, Marines deftro^ing tbr

from and after the faid twenty-fifth Day of March one thoufand feven hundred and fifty-nine, any G»in=' Officer or Marine, fhall, without Leave of the Lord of the Manor, under his Hand and Seal firit had and obtained, take, kill or deflroy any Hare, Coney, Pheafant, Partridge, Pigeon or any other Sort of Fowls, Poultry or Fifh, or his Majefty's Game, within the Kingdom of Great Bri- tain; and upon Complaint thereof fliall be, upon Oath of one or more credible Witnefs or Wit- neffes, convidcd before any Juflice or Juflices of the Peace, who is and are hereby impowered and authorized to hear and determine the fame ; (that is to fay) every Officer fo ofFending fhall, for every fuch Offence, forfeit the Sum of five Pounds, to be diflributed among the Poor of the Place where the Offence fhall be committed; and every Officer commanding in Chief upon the Place, for every fuch Offence committed by any Marine under his Command, fhall forfeit the Sum of twenty Shil- lings, to be paid and diftributed in Manner aforefaid ; And if, upon Conviction made by the Juflices of the Peace, and Demand thereof alfo made by the Conflable or Overfees of the Poor, fuch Officer fhall refufe or negledl, and not within two Days pay the faid refpe£live Penalties, fuch Officer fo refufmg or negledting fhall forfeit, and is hereby declared to have forfeited his Commiffion, and his Commiffion is hereby declared to be null and void. ' XXXIII. And whereas feveral Marines, who being duly entered, may aftervi'ards defert, and

  • be found wandering, or otherwife abfenting themfelves illegally from his Majefty's Service ;'

It is hereby further enaded. That it fhall and may be lawful to and for the Conflable, Head- ConflaWes may appfc- borough or Tythingman, of the Town or Place where any Perfon, who may be reafonably fufpec- hend Deferters, and carry ted to be fuch a Deferter, fhall be found, to apprehend, or caufe him to be apprehended, and to^^^*" t^^o'^e^M'" j caufe fuch Perfon to be brought before any Juftice of the Peace living in or near fuch Town or Place, who is hereby impowered and required to examine fuch fufpefted Perfon ; and if by his Con- feffion, or the TeiHmony of one or more Witnefs or Witnefles, upon Oath, or by the Knowledge of fuch Juftice of the Peace, it fliall appear or be found, that fuch fufpeded Perfon is a Marine duly entered, and ought to be with the Company to which he belongs ; fuch Juftice of the Peace fhall Juftice to commit them, forthwith caufe him to be conveyed to the Gaol ©f the County or Place where he ftiall be found ; or to the Houfe of Correaion, or other publick Prifon, in fuch Town or Place where fuch Deferter fhall be apprehended ; or to the Savoy^ in cafe fuch Deferter fhall be apprehended within the Cities of London ox Wcjlminjier^ or Places adjacent ; and tranfmit an Account thereof to the Secretary of and tranfmit an Account the Admiralty for the Time being, to the End fuch Perfon may be proceeded againft according to to the Secretary of the Law: And the Keeper of fuch Gaol, Houfe of Correaion or Prifon, ftiall receive the full Subft- ^dn^iraity. ftenceofevery fuch Deferter, during the Time he ftiall continue in his Cuftody, for the Mainte- ^,'°i:'fX'^!lnw, nance of fuch Deferter; but ftiall not be entitled to any Fee or Reward, on account of the Impri- ters lonment of any fuch Deferter; any Law, Ufage or Cuftom to the contrary notwithftanding.
