Lobfters, Soles or Whitings, {hall be brought to or be intrufted with, any fuch Salefman or Faftor as aforefaid, to fell, every luch Salefiran or Factor, before he or fhe fliall fell, or offer or expofe t6 or for Sale, any of fuch other Frefh Sainton, Salmon Trout, Turbot, Large Frefh Cod, or Half Frefh Cod Fifh, Haddock, Scate Filh, Frefh Ling, Lobfters, Soles or Whitings as aforefaid, (hall add a true Account or Particular thereof to the Account fo before put up : And fhall take Care that every fuch Account and Accounts which (hall be fo put up, (hall continue up where the fame {hall have been firft placed, until all the Fifh fpecined therein fhall be fold, or the Fifh Alarket of the Day on v/hich the fame fliall be fo placed up {hall be over or ended, without being defaced or obliterated ; upon Pain that every one one who fhall in any wife offend in the PremilFes, or who {hall wilfully take down, deface or obliterate any Account which (hall be placed up as aforefaid during the Time the fame ought to continue up, and (hall be convicled of any fuch Offence (othcr than and except the taking down, defacing or obliterating fuch Account, which fhall be placed up as aforefaid) on his, her or their own Confeffion, or by tiie Oath of one or more Witnefs or Wit- neffes, before any fuch Juftice or Juftices as aforefaid, lliall for every fuch Offence, forfeit and pay the Sum of ten Pounds ; and that every Perfon who fhall be convidlied in Manner as aforefaid, of taking down, wilfully defacing, or obliterating, or caufmg to be taken down, defaced, or obliterated any fuch Account placed up as aforefaid, at any Time whilil the fame ought to have continued up {hall, for every fuch Offence, forfeit and pay the Sum of forty Shillings. XIII. And for the better Prefervation of the Spawn, Brood, and Fry of Fifh, and for prevent- ing the Sale of fmall and unfizeable Fifh, and Fifh out of Seafon, Be it further enacted by the Authority aforefaid. That no Perfon (hall at any Time after the faid twenty-fourth Day of June take, kill or deftroy, or knowingly have in his or her Poffeffion, either on the Water or on Shore «y. ^t«,wii V ^ ^^ ^'^ bring to Shore, or cry, carry about, fell, offer or expofe to or for Sale, or fhall exchano-e der's'incheVlongTwhTch ^o ^"Y Goods, Matter Or Thing, any Spawn, Fry, or Brood of Fifh, or any unfizeable Fifli, Sr flioUbe found in any Per- any Fifh out of Seafon, or any Smelt which fhall not be full five Inches in Length, from the Nofe to the utmolt Extent of the Tail thereof; and if any one (liall offend in the PremilTes, it fhall be lawful for any other Perfon or Perfons, under the Authority of this Adt, to take and feize all or any fuch Spawn, Fry or Brood of Fifh, or any unfizeable Fifli, or any Fifh out of Seafon, or any Smelt of lefs Size than five Inches from the Nofe to the utmofl Extent of the Tail thereof, where- ever the fame fliall be found, together with all Baskets and Package in which the fame fhall be fo found or taken, and alfo to charge a Conftable, or other Peace Officer, with every fuch Offender and Offenders in the Premiffes ; and after every fuch Seizure (hall be made, the Spawn, Fry or Brood, or other Fifh, as aforefaid, together with the Baskets and Package in which the fame (hall be fb feized, fliall be delivered into the Hands of fome Conftable, or other Peace Officer; and every fuch Conftable, or other Peace Officer, is hereby authorifed and required to take every fuch Of- fender and Offenders, with whom he (hall be fo charged for any fuch faid Offence, into his Cu- ftody, and alfo the Spawn, Fry or Brood of Fifh, and all unfizeable Fifh, and Fifh out of Seafon, and all unfizeable Smelts, and all Baskets and Package in which the fame (hall be fo feized, and which fhall be delivered to fuch Conftable, or other Peace Officer, as aforefaid, and to carry every fuch Offender and Offenders, and all fuch Spawn, Fry or Brood of Fifh, and all unfizeable P'ifh, and Fifli out of Seafon, and all unfizeable Smelts, together with the Baskets and Package, as afore- faid, which fhall have been delivered to any fuch Conftable, or other Peace Officer, with all con- venient Speed, before fome Juftice or Juftices as aforefaid, for fuch Offender and Offenders, to be dealt with according to Law; and on the Convidion of any fuch Offender or Offenders, for any fuch fiiid Offence, before any fuch Juftice or Juftices, as aforefaid, every fuch Offender and Of- fenders fliall forfeit all and every fuch Spawn, Fry or Brood of Fifli, unfizeable Fifh, and Fifh out of Seafon, and every Smelt and Smelts of lefs Size than five Inches from the Nofe to the utmoft Extent of the Tail thereof, which fhall be fo feized, together with all Baskets or Package in which the fame ftiall be fo feized, and all fuch Spawn, Fry or Brood of Fifh, unfizeable Fifh, and Fifh out of Seafon, and unfizeable Smelts, together with fuch Baskets and Package in which the fame (hall have been fo feized as aforefaid, fhall by Order of the Juftice or Juftices before whom the fame fliall be fo brought, be delivered to the Perfon or Perfons who fhall have fo feized the fame, and (hall profecute to Conviition any fuch Offender or Offenders ; and every Offender and Offenders in the Premifies, who (hall be convicted as aforefaid of any fuch Offence, (hall befides forfeit and pay for every fuch Offence the Sum of twenty Shillings. XIV. And be it further enadcd by the Authority aforef^iid.
