D. 1759, Baron, or either of them, or otherwife, in the due Execution of their Office ; or if fuch Bailiffs or other Officers of the faid refpedtive Courts Baron, or any of them, (hall negledl or refufe to make due Execution of the feverai Procefles ilTuing out of the fame Courts Baron refpeilively, or fhall in any refpe<fl mifbehave himfelf or themfelves in the due Execution of his or their Office or Offices, or offend contrary to the true Intent and Meaning of this A6V, and due Proof (hall be made thereof in open Court to the Satisfaction of the refpe£tive Stewards of the faid feverai Courts Baron, or their refpeilive Deputies, upon the Oath of fuch Bailiff or Bailiffs, Officer or Officers, or other credible Perfon or Perfons (which Oath and all other Oath and Oaths herein before men- tioned or directed to be adminiflered in the faid refpeilive Courts Baron, in purfuance of this Adl, the refpecStive Stewards of the faid Courts Baron refpedtively, or their refpedlive Deputies, are here- by, from time to time, fcverally authorized and required to adminifter) ; then, and in fuch Cafe, it fhall and may be lawful to and for the refpe*3:ive Stewards of the faid Courts Baron, or their Depu- ties, to fine fuch Offender or Offenders in any Sum or Sums not exceeding forty Shillings ; which Fine or Fines fo to be fet or impofed, together with the Cofls and Charges of levying thereof, (hall and may be recovered by Diftrefs and Sale of the Offenders Goods and Chatties, by Warrant under the Hands and Seals of the refpective Stewards of the refpedlive Courts Baron, or their Deputies, and be applied to and for the Ufe of his faid Majefly, his Heirs and Succeflbrs, in the Right afore- faid ; and if the Perfon or Perfons fo offending fhall not be a Houfeholder or Houfeholders within lurifdiction of the Court ^^^ Jurifdiilion of fuch of the faid Courts Baron in which fuch Fine or Fines fhall be affelled or im- may be committed, on pofcd, that then it fhall and may be lawful to and for the refpe(5live Stewards of the faid refpedtive Courts Baron, or their Deputies, by Warrant under their refpe£tive Hands and Seals, to commit fuch Offender or Ofl^enders to Prifon, or to the Cuflody of any of the Bailiffs or Officers of or be- longing to the faid refpedlive Courts Baron for any Number of Days, not exceeding forty Days, un- Icfs fuch Fine or Fines (hall be fooner paid ; in which Cafe the Offender or Offenders (hall be forth- with difchargcd out of Cuftody, and (buffered to go at large. XLIII. And be it further ena6ted, That the Prifon or Gaol for the Time being, kept by the Bai- liff or Keeper of the Gaol of the Hundred oi High Peak^ or fuch other Place within the Jurifdiilions aforefaid, or either of them, as the Stewards of the faid refpedtive Courts Baron, or their Depu- ties (hall from time to time, by Writing under their Hands and Seals, nominate or appoint, (hall be and be ufed as and for the Prifon or Gaol for the faid Courts Baron, and in which all Perfons who (hall be taken in Execution, or be committed or detained by virtue or in purfuance of this Aft, (hall and may be kept in fafe Cuftody ; and the faid Bailiff or Keeper of the Gaol of the Hundred oi High Peak, or his Deputy, and fuch other Perfon or Perfons as (hall by vir- tue of this ASt be appointed Bailiff or Keeper of fuch other Prifon within the Jurifdidions aforefaid, for the time being, or either of them, is and are hereby authorized and required to receive and detain all fuch Perfons as (hall be committed to his or their Cuftody by virtue of this Aft. XLIV. And be it further enafted. That the Fees which (liall be paid, had and taken by the refpeftive Stewards of the faid Courts Baron refpeftively, or their Deputy or Deputies, and by the Bailiffs of, and other Perfons praftifing in, the faid feverai Courts, for or in refpeft of the Pro- ceedings in any Plaint, Suit or Aftion to be brought or depending, in the faid Courts Baron refpec- tively, in Conformity to this Aft, or of any other Matter herein contained, (hall be fuch as herein after are meniioncd ; and no greater Fees (liall be taken in refpeft thereof than as follows } that is to fay, Fine to be levied by Diftrefs and Sale. Fees of Court, FEES to be taken by the refpedive Stewards or their Deputies, FO R entering every Plaint, four Pence. For every Summons thereon, four Pence. For Hling every Plea of General Illue, Special Plea, or Demurrer, fix Pence. For Copy of every Plea of General llfuc.
