Penalties on dedroying XXVII. And be it further enacled. That if any Perfon fhall, at any Time or Times hereafter, ^o^^^f wilfully or malicioufly cut the Bank againfl Peaver's Loady above L'ltly Droveway^ and fhall be thereof convicted upon the Oath of one or more credible Witnefs or WitnefTes, before one Juflice of J:he Peace for the fiiid County of Sujffolk ; every Perfon fo convicted fhall forfeit, for every fuch Offence, the Sum of ten Pounds, to be levied by Diftrefs. and Sale of the Goods and Chattels of fuch Offender or Offenders, by Warrant under the Hand and Seal of the Juftice before whom fuch Conviction fhall be had ; five Pounds thereof to be imployed in carrying on the Works and Im- provements in and upon the Fen Lands and Low Grounds within the faid firft Diflridl ; and five Pounds thereof to be imployed in tarrying on the Works and Improvements in and upon the Fea Lands and Low Grounds within the faid fecond Diftridt ; and for want of fuch fufficient Diftrefs, fuch Ofl'ender or Offenders fliall, by the faid Juftice, be committed to the Houfe of Corredtion, or Common C-jaol for the faid County of Suffolky for any Time not exceeding two Months: And if any Perfon fhall wilfully or malicioufly cut, throw down or deftroy any of the Banks, Works or I^ngines fo to be made or eredted as aforefaid, or by any ways hinder, obftrudt, or lay open any of the Cuts, Drains, or other Works, to be made for draining or improving the faid Fen Lands or Low Grounds as aforefaid, and fhall be convidted of fuch Oft'ence, upon Oath, before two of the Juftices of the Peace for the faid Ifle of Ely, if the Offence fhall be committed within the faid Ifle, or before two Juftices of the Peace for the faid Counties of Suffolk or Norfolk, refpectively, if the Off'ence fhall be committed in either of the faid Counties ; every Perfon fo convidted thereof fhall forfeit for every fuch Offence the Sum of one hundred Pounds, to be levied by Diftrefs and Sale of the Goods and Chattels of every fuch Offender or Offenders, by Warrant under the Hands and Seals of any two of the faid Juflices before whom fuch Convidtion fhall be had, to be imployed in carrying on the Works and Improvements in and upon the faid Fen Lands and Low Grounds with- in the Diftridt or Divifion where fuch Offence is or fliall be committed; and for want of fuch fiiifi- cient Diftrefs, fuch Offender or Offenders fhall, by the faid Juftices, be committed to the common Gaol of the faid Ifle of Ely, or Counties of Suffolk or Norfolk rcfpedtively where the Offence ftiall be committed, there to remain without Bail or Mainprife, for any Time not exceeding twelve Ca- lendar Months, at the Difcretion of the faid Juftices : And if any Perfon fhall wilfully or mali- cioufly fet fire to, burn, or otherwife deitroy any of the faid Engines to be eredted as aforefaid, and be thereof lawfully convidted, fuch Perfon fhall be adjudged guilty of Felony; and fhall be fubjedt and liable to the like Pains and Penalties as in Cafes of Felony : And the Court, by or before whom fuch Perfon fhall be tried, fliall and have hereby Power and Authority to tranfport fuch Felon for feven Years, in like Manner as other P'elons are diredted to be tranfported by the Laws and Statures of this Realm ' •T tn»klnc Waterinj; XXVlll.
