Acre for every Acre of private Property, four Pence an Acre for every Acre of Half Year's Land, and two Pence an Acre for every Acre of Common Land, during fuch Time as the fame fhall be ufed as Common ; but if any fuch Land fhall be afterwards inclofed, and ufed in Severalty, then fuch Land fhall be taxed at any Rate not exceeding fix Pence an Acre for every Acre fo inclofed, during fuch Time as the fame Ihall remain inclofed (other than and except fuch Common Lands as fliall be in- clofed in purfuance of this A61 for defraying the faid Taxes). XVL And be it further enacted, That the Taxes to be raifed by virtue of this A£l for the general Works of Drainage, fhall be, and the fame are hereby, veiled in the General Commiflioners j'or the general Works of Drainage, appointed and to be eledled by virtue and in purfuance of this Act, and the fame (hall be applied and difpofed of in the Execution of this A6t, fo far as the fame relates to the general Works of Drainage, and the neceflary Cous, Charges and Expences attending the fame, and to no other Ufe or Purpofe whatfoever. XVIL And be it further enadted,That the faid General Commiflioners, or any five or more of them, {hall, cut of the Money to be by them raifed, pay to the Proprietors of the Lands lying within the faid fifth and fixth DiftricSts fuch Sum and Sums of Money as they have refpeiSlively laid out and expended in making Surveys of the Lands and Grounds lying within the faid Diflricls, fo as the faid Sum and Sums do not in the Whole exceed eighty Pounds, to be fettled and afcertained in fuch manner as the faid Gei^eral Commiflioners, or any five or more of them, fhall think proper. XVin. And be it further enacted. That it fhall and may be lawful for the Commiflioners of the fecond and fourth Dif{::i6ts refpetStively, or any five or more of them, to charge the low Lands and Fens lying within t'..e faid refpecStive Dift;ri6ts, with fuch further yearly Tax as fliall by them be judged neceflary for the making, erecting and preferving any private Works, Banks, Drains or Engines, with- in the faid refpcdtive Diflrifls, in fuch manner as to them fhall appear neceflary and proper for thePur- pofes of private Drainage ; which faid Works, Banks, Drains and Engines the faid Commiflioners are hereby impowered to raife and eredt in fuch Places, and in fuch Manner, as to them, or any five or more of them, fhall feem mofl: proper and convenient for the faid Purpofes : And alfo that the faid Commiflioners of the firft and third and fixth Diftricts, or any fiveorm.ore of them, and theCommif- fioners of the fifth Diflri^t, or any three or more of them refpedtively, fhall have Power, on Applica- tion to them made by the Lord of the Manor, and the major Part of the Proprietors of taxable Lands within any Townfhip, Parifh or Place lying within the faid fiift, third, and fifth and fixth Diflri£ts refpe6lively, to charge the low Lands and lens, which are made liable by this AcSt to be taxed for the general Drainage, lying within fuch Townfhip, Parifh or Place refpecSlively, with fuch further yearly Tax as fhall by them be judged neceflary for making, erecting and preferving any private Works, Banks, Drains or Engines within fuch Townfhip, Parifh or Place, which to them fhall appear necef- lary and proper for the Purpofes of fuch private Drainage ; which faid Works, Banks, Drains and En- gines the faidCommifTioners are hereby impowered, on fuch Application as aforefaid, to raife and erect in fuch Places, and in fuch Manner, as to them, or any three or more of them, fliall feem moil proper and convenient for the faid Purpofes ; but fo as fuch private Works, Banks, Drains or Engines do not in any wife prevent or obilrruft the Waters occafioned by Soakagc or Dov/nfall from taking their na- tural Courfe into the faid River or Haven below the fame, in regard that the obtaining, eft'eitlng and preferving fuch Courfe and Outfall is intrufted to and under the Controul of the General Commif- fioncrs by the Tenor and true Meaning of this A<5t (except Vv^ith refpeiSt to the Engines already eredted within the faid fifth and fixth Diftri6ts, v/hich are hereby allowed to remain, and not intended by this AcSl to be fubje<Sl: to the Controul of the General Commiflioners) : And that the low Lands and Fens in the fixth Difliridt fliall, jointly and together with the low Lands and Fens through which fuch Wa- ters fhall be conveyed, be taxed and aflelled for and towards raifing Money for paying and defraying the Charges and Expences of deepening, imbanking, repairing, fupporting and maintaining all the prcfent Gowts, Drains, Dykes and Cuts, which are i.ereby allowed to be made ufe of for the conveying fuch Waters into the aforefaid River or Haven, fo long as they continue to ufe the fame, and to dc paid in fuch Shares and Proportions as any five Commiflioners of the faid DiflriiSls, not intereiled in the Pre- mifies (to be for that Purpofe nominated and appointed by the General Commiflioners, or any five or moreof them, for that Purpofe) fhall order, diretSt or appoint: and the Expences of the Commiflioners, who fhall determine the fame, fhall be paid out of the Tax or AflTeil'ment to be laid on the faid fixth Diftridt. XIX And be it further enacted. That if any fuch private Works, Banks, Gowts or Engines, in any one of the faid Diflri :ts, (hall be found beneficial to any otherTownfhips, Parifhes or Places within the fame or any other Diitriit appointed or afcertained by virtue of this /ydt, tlicn fuch Townfhips, Parifhes or Places fhall contribute towards the Charge of making and preferving the faid Works, in proportion to the Benefit they fhall receive thereby; which Proportion fhall be adjultcJ and afcertained by any three or rr.oreof theOcneialCi'mmiflioners, n.)t beingCommiflionerii of any of the Diftriits in qutlHoa; and that the Waters ot each Townfliip, Parifh or Place, lying within the firll and third Diflricts, fhall be ifTued and carried to the River JVithavi down their prcfent Diains, or by Drains within the fame.. XX. And be it further cna£ted.
