C. 37. 703 herein before granted, fhall in the Execution of their Offices ohferve and perform fuch Rules and Orders as they refpedively fhall from time to time receive from the High Treafurer, or the Com- miflioners of the Treafury, or any three or more of them for the Time being ; and that no Fee or and no Fee is to bs Reward fliall be taken or demanded by any fuch Commi/Tioners or Officers, from any of his Majefly's taken by them j Subjects, for any Matter or Thing to be done in purfuance of this A£l ; and in cafe any Officer and neglefting their employed in the Execution of this A6t, in relation to the faid Rates and Duties, fhall refufe or ne- Duty, to the Damage of g]e&: to do or perform any Matter or Thing by this A£t required or direded to be done or per- ^"^ *^^'°"' they are ha- formed by him, whereby any of his Majefly's SubjecTts fhall or may fuftain any Damage whatfoever, fa^J^^^^i^fj^'j-^g^ieVoft* fuch Officer fo offending fhall be liable, by any AcSlion to be founded on this Statute, to anfwer to of Suit j the Party grieved all fuch Damages, with Treble Cofls of Suit. VII. And be it further enacted by the Authority aforefaid. VIII. And be it further en a£led by the Authority aforefaid, That if any Perfon from and after Penalty of counterfeir- the faid fifth Day of July fliall counterfeit or forge, or procure to be counterfeited or forged, any '"6 or forging any of the Seal, Stamp or Mark, to refemble any Seal, Stamp or Mark, direded or allowed to be ufed by this PurlTs?fh>f a« '^* A<^, for the Purpofe of denoting the Duties hereby granted ; or fhall counterfeit or refemble the or of felling any Vei- Impreffion of the fame, with an Intent to defraud his Majefty, his Heirs and Succeflfors of any of Jum, &c. with fuch the faid Duties, or fhall utter, vend or fell my Vellum, Parchment or Paper, liable to any fuch <^ounterfeit Stamps ; Stamp Duty, with fuch counterfeit Stamp or Mark, knowing the fame to be counterfeit; or fhall or of privately ufmg any privately or fraudulently ufe any Seal, Stamp or Mark, directed or allowed to be ufed by this A61:, '^[ ^^° allowed Stamps, with Intent to defraud his Majefty, his Hens and Succeflbrs of any of the faid Duties; every Per- ^^.^'l/S ^^i^hout fon fo offending, and being thereof lawfully convidted, (hall be adjudged a Felon, and fhall fuffer Benefit of cieigy. ' Death as in Cafes of Felony, without lienefit of Clergy. IX. And be it further enadcd by the Authority aforefaid. That the Duties hereby granted, and Duties of this, and of the Duties arifmg by virtue of the faid former A61, made in the thirty-fecond Year of his late Ma- **>« former Aft ot jefly's Reign, fhall be, and are hereby made one joint Fund, for anfwering and paying, in fuch lund for^paying^he'"'"' Manner and Proportions as are therein dircded and appointed, with refpedt to the Duties thereby Judges Salaries j granted, ail fuch Sums of Money as fhall become due and payable from and after the faid fifth Day of "July in purfuance of the faid Aft, to the Puifne Judges in the Court of King's Bench, the Judges in the Court of Common Pleas at Wejiminfler, the Chief and other Barons of the Coif in the Court of Exchequer at Wejlminjier, the Chief and fecond Juftices of Chejler, and the Juftices of the Great and the Surplus tobere- Seffions for the Counties in Wales, for the Time being refpeftively ; and if any Surplus fliall re- ftrved for the Difpofitioa main of the Produce of the faid Fund, the fame fhall be referved for the Difpofition of Parliament, °^ Parhament. in fuch Manner as any Surplus of the Duties granted by the faid A£t are thereby diredled to be referved. . X. And it is hereby enafted by the Authority aforefaid. That if any Perfon or Perfons fhall at any Time or Times be fued or profecuted for any Thing by him or them done, or to be done or executed in purfuance of this Aft, or of any Matter or Thing in this Aft contained, fuch Perfon or Perfons fhall and may plead the General llTue, and give the Special Matter in Evidence for his or General Iflue, their Defence; and if upon the Trial a Verdift fhall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs fhall become nonfuited, then fuch Defendant or Defendants fhall have Treble Treble Cofts, Cofts to him or them awarded againfl fuch Plaintiff or Plaintiffs. CAP. XXXVII. An Ad for vefting certain Lands, Tenements and Hereditaments upon the Sea Coafls, . in the Counties of Kent, Sujfex and Soutbamptorty on which Forts and Batteries have been eredled for the Defence of the faid Coalts, in Truftees, for certain Ufes j and for other Purpofts therein mentioned. WHEREAS the Coafts of Sujfex, Keni and Southampton, lay open and expofed to the Preamble, hoftrle Invafions of his Majeity's Enemies : And whereas our late moft Gracious Sove- reign Lord George the Second, out of his paternal Affeftion, tendering the Welfare and Pro- tedticn of his dutiful and loyal Subjefts, did order and direft the Mafler General and Principal Officers of his Ordnance, to ereft and build feveral Forts and Batteries, at convenient Diftances, upon the faid Coafts : And whereas in purfuance of fuch Orders, Forts and Batteries have been eiiccted by and wiih the Confent of the Owners and Proprietors of the feveral Lands herein
