ITEM, Becaufe notwithftanding the oft and frequent Preachinges , in deteftation of the grievous and ab- hominable aithes fwearing , execrationes , and blafphematioun of the name of God , fwearand in vaine be his precious blud, bodie, paffion and wounds , Devill flick, cummer , gore , rOift or riefe them , and fik uther oug-fum aithes and execrationes againft the command of God, zitthefaminiscuminfik ane ungod- lie ufe amangft the people of this Realme, baith of great and fmall Eftaites , that dailie and hourelie may be heard amangft them open blafphemation of Godsttame , and Majeflie , to the greate contemption thereof, and bringing of the ire and wrath of God upon the people : Herefore, and for efchewing of fik inconve- nientes in times cumming : It is ftatute and ordained, that quhat-fumever perfon or perfones, fwearis fik abhominable aithes , and deteflable execrationes , as is afore rehearfed , fall incur the paines after following, als oft as they failzie , r effective : That is to fay, ane Prelate of Kirk, Earle or Lorde ,. for everie fault to be committed for the fpace of three Monethes nixt-to*cum : That is to fay , unto the firft day oiMay , ex- clufive , twelve pennies : Ane Barronne or beneficed man , cOnftitute in dignitie Ecclefiaftical , foure pennies: Ane Landed man , Free-halder , Vaflali, Fewar, Burges, and fmall beneficed men , twi pennies : Ane craftef-man , zea-man, ane fervand man, and all uthers ane pennie. Item, the puirfolkes that lies nageare, to pay the paine forefaide, to be put in the ftockesdr prifoned, for the fpace of foure houres, andwementobeweyedandconfiddered, conforme to their bloude or Eftaite of their parties, that they ar coupled with : And this paine to be doubled upon everie committar , after the out-running of the faidis three Monethes , for the fpace of uther three Monethes thereafter : That is to fay , fra the firft day of kJMmj , unto the firft daye of t_^#£«/?, exclufive , and from the firft day of ^Augufl , unto the firft day of November , exclufive , the paine to bee tripled, that is to fay, for everie pennie, three pennies : And fra the faide firft day o{ November , to the firft day of februar thereafter, quhilk makis the zeir compleit, the paine to be quadruple , that is to faye , for everie pennie , foure pennies , efteirand to their Eftaite. And ft a the complect- ing of the faid zeir, the firft fault of ane Prelate , Earle or Lorde , to be foure fhillinges , the fecond fault, audit fhillinges , and the thrid fault , fexteene fhillinges , and for the fourth fault , to be banifhed , or put in warde, for the fpace of zeir and daye , at the will of the Prince, and fik-likeofall uther Eftaites, after their qualitie forefaide , to be punifhed effeirandlie. And this forefaide paine to bee applyed to the puir folkes; be them that fall be depute colled oures thereof. 17. t_Anent them that ferturbis the Kirk, the time of divine fervice. ITEM, It is ftatute and ordained, againft all perfones quhilkis contemnandlie makis perturbation in the Kirk , the time of divine fervice , and Preaching of the worde of G O D , ftoppand the famiri to bee heard and feene be the devoute people , and will not defifl and ceafe therefra , for na Spirituall monition , that the Kirk-men may ufe upon them : Therefore quhat-fumever perfori makis perturbation or impediment in the Kirk, in maner forefaide, fall incurre the paines , as aker followis : That is to fay, for the firft fault , ane Prelate , Earle or Lorde , ten pounde : ane Barronne or perfon , conftitute in dignitie Eccefiaftical , five pound, ane Vaflali, Free-halder, Burges, or fmall beneficed man, fourtie fhillinges , and uthers twentie fhillinges, and puir folkes that hes na gudes , tobeputinprifonforfifteenedaies, to faft on bread & water , and for the fecond faulte , the doubling thereof , and for the thrid faulte , warding of their perfones , or banifh- ing for zeir and day, and ordainis the Deane of Gild, Kirk-maifters , andreulers, to gar leifche bairnes ,' that perturbis the Kirk , in maner forefaid. 1 8. ^Anent them that knawis them/elves under proces ofcurfing. ITEM, That becaufemony perfones wittandlie knawand themfelves under the procefle ofcurfing, and beand charged to remove fra divineiervice , wilfullie enteris themfelves thereto, and will not remove; quhair-throw they ftop the remanent Chriftian people fra divine fervice, and incurris the great curfing of the Law. Therefore it is ftatute and ordained, that quhafaevet beis noted and convicted to have remained in the Kirk , the time of divine fervice , after that he have bene warned and charged to remove , beand under proces ofcurfing denunced upon him dewlie , outher openlie in his Paroche Kirk , or perfonally , to be punifhed as perturbers of the Kirk of God , and to incur the paines of the forefaid laft adle . 19. Anent them that maries iwa wives or husbandes. ITEM, It is ftatute and ordained , that quhat-fum-ever perfon maries twa findrie wives , or women maries' twa.fi'ndrie husbandes , livand togidder un-divorced lauchfullie , contrair the aith andpromife maid at the folemnization and contracting of the matrimonie , and fwa ar of the Law perjured and infamous : Therefore, that the paines of perjuring be execute upon them with all rigour : 1 hat is to fay , confifcation of all their gudes moveable , warding of their perfones for zeir and day , and langer in-during the Queenis will ,' and as' infamous perfons, never able to bruik office, honour, dignitie, nor benefice in time td-cum. ^ Z x £0. ^Anent
