ITEM, Becaufe the acle concerning Notars, maid be the Kingis Grace, King JAMES the Fifth, quhom GOD affoilzie , lies not hidder-nlles bene put to dew execution : Therefore it is thocht expe- dient be the Lord Governour , and the three Eftaites of Parliament , that the faid afte be put to execution in all poyntes , after the forme and tenour of the fame , betuixt this and the laft daye otcJMarch , nixt to-cum, with this addition following : lhatistofay, that cverie Schireffe within the boundes of his office, betuixt this and the faid daye, bring, or fend all Notars , Temporal men , and the Ordiuares , to bring or fend all Spi- ritual Notars to the Burgh of Edinburgh , and there prefent them to the Lordes of Councell , to be examined be them, gif they be able, worthie , and qualified for the faid office of Notarie, and there to be admitted be them thereto, fufpendand fra the faide laft day of March furth , of all Notars, unto the time of their admiffion forefaid : With certification to them , that ufis the Office of Notarie , fra the faid day furth , before they be admitted in maner forefaide: That their inftrumentes fall have na faith, and themfelves fall be pumlhed as falfars of the Law. zf. ITEM, It is ftarute and ordained, that the afte and ordinance maid before in Councell, anentisthe efchewing of dearth , and the ordouring of everie mannis houfe in his courfes and diihes of mcate , be ob- ferved and keiped in all poyntes , after the forme and tenour thereof, and under the paines conteined in the famin : Of the quhilk the tenour followis : 1 he quhilk daye , for-fa mcikle as the Queenis Grace , the Lordc Governour , and Lordes of fecreir Councell , havand refpecTto the great and exorbitant dearth , rifen in this Realme of vicTualles , and uther fluffe, for the fuftentation of mankinde , and dailie increaf land. And gif ony Lord, Abbot, Priour or Deane , Tailzies and breakis the faid acle , he fall content and pay for everie failzie, ane hundreth markes , and gif onie Barronne or Free-halder failzies , he fall pay at everie time and failzie, fourtie . pound : And gif ony Burges or uther fubftantious man, Spiritual or Temporal failzies , hee fali paye at everie time and failzie, twentie markes in maner forefaide: And gif ony uther fmallperfon or periones, wauld prefume to breake this prefent acTe and ordinance , or do in the contrair , he fall be taken and pumlhed in his perfon and gudes, at the Lorde Governours will, for their contemption. And quhat-fum-ever uther perfon orperfones, of quhat-fum-ever Eftaite , degree, or condition that ever they bee of, that failzies and breakis this ordinance , that he fall be repute and halden, as ane man given to his voluptuoufnes , and contemnar of the authoritie , and not to the commoun weill : And howbeit , that ony man of greater Eftaite , nor ane Burges cum in Burgh to anie Burges ludgeing, It fall not bee leafum to the faid Burges to make onie maa diihes bot effeirand to the Eftaite of the Maifter awner of the faide ludgeing, without that the Lordc, Barronne or ftranger make his awin provifion and table, alwaies within the ordinance forefaid : Providing alwaies, that this prefent acre and ordinance ftricke not upon manages , nor banquettes to bee maid to ftrangers of uther Realmes, and the faid banquettes to bejnaid allanerlie be Arch-Bifhops, Biihops, Karles, Lordes, Abbottes, Priores, Deanes, Barrorines, Proveftes and Baillies of Burrowes. And in likewife providing that na Scottif- man make banquet to ony uther ScottiJ-man, bot in maner forefaid : And for the mair fure keiping of the faide afte and ordinance, ordainis that the Schireffe of the Schire' and their deputes , Proveftes, Aldermen and Baillies of Burrowes , ilk ane within his awin boundes andjurifdicTion , to take inquifition of the breakers of the famin, and roll their names, and deliver the famin to the Lord Thefaurar , to the effect: that the perfones breakers and contemnars of the faid acT, may be called to Juftice 'aires or particular diettes , as the Lord Go> vernour and Councell fall thinke maift expedient, and punifhed in manner forefaid. 2,7.
