OUR SOVERAIGNE LORD, with confent of the Eftaites of this prefent Parliament, ftatutes and ordaines that na perfon nor perfons , take upon hand in tyme comming to tranfport forth of this Re- alme, or inbring within the famine any forbidden or uncuftomed goodes under the payne of tynfell of their movable goodes that fhall happen to come in the contrare hereof. 1 hat is to fay , the faids forbidden and un- cuftomed goods that mall happen to be taken and apprehended, to apperteine as efcheat to OUR SOVE- RAIGNE LORD, and to be intrometted with, and up-taken by his Heighnes Comptroller , and compt thereof to be made by him in the Checker , and the remanent of the movable goodes and geare perteining to the contraveiners of this prefent aft , to be efcheat for their contemption by OUR SOVERAIGNE LORDS Thefaurer. For the whilk he fall be lykewyfe oblillied to make compt in all tyme comming. And difcharges all licences alreadie granted to that effect, and that no licence pafle hereafter, except the famine be paft in Counfeil , and pafle the haill Seales , and pay compofition to his Heighnes. And ordaines letters to be direft hereupon as effeirs. 16. Ratification of the afis made of before in favours of the Kirk. OUR SOVERAIGNE LORD, With advyceoftheEftaitesofthis prefent Parliament, ratifies, approves and confirmes the libertie of the true and holy Kirk and Religion, prefentlie profefled within this Realme , and eftabliihed by the Lawes of the famine ; and all afts , conftitutions and immunities made and graunted to the famine, alfwell in his Heighnes minoritie as fince his perfite age. And ordaines the famine to be put to execution in ali poyntes , agamft ail perfons whatfomever in all tyme comming. 1 7. Aei ancnt 11011 Communicants. OUR SOVERAIGNE LORD, with advycc of the Eftaites of this prefent Parliament , Ratifies, approves and confirmes the Aft made in the convention of the Eftaites at Haly-rude-houfe , the day oi October , the yeare of God 1^98. anent non Communicants , whereof" the tennour followes. F O R- SAMEIKLE as by diverfe and fundrie lovable Aftes of Parliament , made by his Heighnes , and his urn- whyle Mother of good memory , fince the reformation of the Religion. It is ftatute and ordained,' that all his Heighnes fubjefts fhould embrace the Religion prefently profefled, alfwell by hearing of the word, as participation of the Sacraments. Notwithftanding whereof, fundrie perfons of the Realme abfteins from die receavingofthe Communion and Lords Supper, pretending an excufe of rancour and malice that they have in their myndes, againftfome of their Neighbours, bearing them at deadly feed. Alledging folong as the famine rancour remaines with them, and they nowyfe reconciled with their faids Neighbours , that they can not worthelie receave the faids Sacraments , and can not juftly be burdened by the Miniftrie to doe the famine. Whilk pretended excufe is nothing but a cullour and clock to cover their Papiftrie , whilk is the onely caufe of their abfteining to communicat. And in fo far as by the afts of general Aflemblie , it is found that deadly feed can be no lawfull caufe why any perfon fliould debar himfelfe from the Seales and Sacraments of his Communion with Chrift. Therefore his Heighnes with advyce of the Eftaites prefentlie conveined , hes ftatute and ordained , that all his Heighnes fubjefts fliall communicat once every yeare ; and fhall no wyfe pretend any excufe of deadly feade, rancour or malice to appeare towards their neighbours. And when ever it fhall happen any to ab- Iteine or debar himfelfe from the participation of the faid Sacrament , upon the pretence of the faid excufe, or any other caufe whatfomever , they being firft lawfully requyred by their Paftor or Presby tcrie to doe the famine; that then they fhall be aftticlicd to pay the particular penalties under written, enjoyned to them , and that to his Heighnes Thefaurer. That is to fay , every Eade fo oft as he fhall contravene the ptemifles, a thoufand pounds. Every Lord, a thoufand markes. Every Barron, five hundreth pounds. Every Free - halder, three hundreth markes. Every Yeoman, fourtie pounds. And every Burges according to the mo- dification of the Kings Majeftie and Lords of fecret Counfeil. Whilkespames, the faids Eftaites lies or- dained OUR SOVERAIGNE LORDS Thefaurer, to execute with all extremitie againft the con- traveiners hereof, and to intromet there- with to his Heighnes ufe. 18. Ratification of the aii anent Jefuits , Treifis, excommunicat and traffiking Tapifls. OUR SOVERAIGNE LORD, with advyce and confent of the Eftaites of this prefent Parlia- ment, Ratifies, approves and confirmes the ad made in the fecret Counfeil at Sanft Johnfton , the firft day of Apryle 1 600. yeares. Anent the Jefuits, Seminarie Preifts, excommunicat and traffiking Papifts, common enemies to all Chriftian Governement , whereof the tennour followes. For-fameikle, as by diverfe Afres and Proclamations made and publifhed heretofore , all Jefuits, Seminarie Preifts , excommunicat and traffiking Papifts , common enemies to all Chriftian Governement , are fpecially commanded to depart and pafle forth of this Realme , under certaine paines mentioned in the famine aft.
