ITEM, His Majeftie with confent forefaid, revokes, cafles, annuls, retreats and refcinds all tackes , affedations whatfoe ver of any common Churches within the Realme of Scotland , made by his Majeftie , or his faid umwhile dcareft Father , or any other his Majefties PredecefTors , Kings of Scotland , in fo far as the fame is or may be found and verified to be made againft the Lawes and Ads of Parliament of the Kingdome ; Providing alvvaies, that there mall be fufneient Minifters appointed to ferve the faids Churches, who mail make refidence , and ihall be fufliciently fuftained of the readieft fruits of the faids common Kirkes , according. to the general order taken thereanent. ITEM, His Majeftie , with confent forefaid , revokes , cafies , annuls , retreats and refcinds all gifts of Monkes portions , firft fruits or fift penny of any benefices, whereunto His Majeftie hath right by the Ads of Parliament made before to that end , And that in fo farre as the faids gifts arc or may be found to be granted againft the Lawes of the Kingdome. ITEM, His Majeftie, with confent forefaid, revokes, cafles, annulls, retreats and refcinds all gifts and Infeftments , made, dene, and confented unto , to whatfoever perfon or perfons by His Majeftie, or his Majefties faid umwhile deareft Father, or any other his Majefties predeceffors , Kings of Scotland, of whatfoever advocation , donation , and right of Patronage given or annexed to any Lordfhips , Lands or Baronie where the faid Patronage, Advocation and donation of benefice pertained not before of right, but which taketh the beginning and ground from any gift and Infeftment thereof made with this cl3.ufe(denovo damns) where the purchafer of the faid infeftment had no right to the faid Patronage, Advocation and Don- ation of before. And that in fo farre as the fame is or may be found to be granted againft the Lawes and Acts of Parliament of the Kingdome. ITEM, His Majeftie, with confent forefaid , revokes, cafies, annuls, retreats and refcinds all gifts, difpofitions of fuperplus omitted of the fruits of benefice , given by his Majeftie , his faid umwhile deareft: Father or any other his Majefties PredecefTors ', Kings and Queens of Scotland, info farre as the fame is or may be found and verified to be granted againft the Lawes and Acts of Parliament of the Kingdome. I T EM, his Majeftie, with confent of the Eftates , revokes, cafles, annuls, retreats and refcinds all grants and infeftments of erections, of whatfoever Abbacie or other Prelacie , in whole or in part , Tempo- ralitieor Spiritualitie thereof, made and granted, or confented unto by his Majeftie at any time preceeding the date hereof , to and in favour of whatfoever perfon or perfons, and declares the fame null and of none avail , by way of action , exception , or reply , and als his Majeftie and Eftates , revoke all infeftments of Erections made and granted by his Majefties faid umwhile deareft Father, or any of his Majefties prede- ceflbrs Kings or Queens of Scotland , of whatfoever Abbacie , Priorie , Nunnerie , Preceptorie , or any other Erected benefice whatfoever, of whatfoever nature, qualitieor condition whereof the prefentation fliould pertaine to his Majeftie , if the fame were not erected in a Temporal Barronie , Lordfhip , or Living , or of any part or pendicle thereof, either Spiritualitie or Temporalitie of the fame to and in favour of what- foever perfon or perfons , And that in fo farre as the fame is , or may be verified to be granted, againft the general Lawes and Acts of Parliament of the Kingdome. And to that effect revokes, cades, and annuls, retreats and refcinds all Acts , ftatutes , and diflblurions of any of the faids erected benefices , Lands or Teinds of the fame , whereupon the faids infeftments of erections are , or have been founded : And that in fo farre as the fame is or may be found and verified to be comrade to the general Lawes , Acts of Parliament , and ftatutes of the Kingdome , as faid is. AND generally his Majeftie, with confent forefaid , revokes, cafles, annuls, retreats, and refcinds all Acts, conftitutions , difpofitions, grants, conveyances, ratifications, and all other things whatfoever done or confented unto by his Majeftie at any time preceeding the date hereof, or by his umwhile deareft Father, or any other his Majefties predeceflbrs , Kings and Queens of Scotland , in detriment of their foule and confeience : in hurt and detriment of the Crowne and Church, and contrarie to the Lawes and Acts of Parliament of the Kingdome. And wils and declares, that thefe prefents fliall be als amply extended, and to be of als great effect in general and fpecial , as any revocation made by any of his Majefties Royal Pre- deceflbrs before the date hereof, contained in the bookes of Parliament, which in all heads, claufes, aqd circumftances thereof are holden as here repeated. AND alfo his Majeftie , with confent of the Eftates , ordaines and decernes , that albeit it fliall happen his Majeftie for any refpect or confideration,to fuffer any perfon or perfons,to ufe or pofTefle any priviledges 01 poffefTions, lands, rents, offices, which are fallen under the compafle hereof , That it fhall make no right tc the ufers and holders thereof, but it fliall be lawful to his Majeftie and his fuccefibrsto intromit therewith when ever it fliall pleafe them by vertue of thefe prefent Acts and confuetudes of the Realme made before without any obftacle , impediment or contradiction.
