I;/ Favour of the Earle of Mortoun , and the Lord Dalkeith his Sonne; Anent the Loch of Leivcn, and prefirvation of the fijhings thereof. OUR SOVERAIGNE LORD, And Eftates of this prefent Parliament, confideringthattheLOchof Loch Leivn pertaines heritably in propertie to his Majefties right truftie Coufin and Counfellor JVillmm Earleof 'tMortom, Lord great Thefaurer of this Realme, and Robert Lord Dalkeith his Sonne; And that the faid Loch is well plemllied and furnifhed with Pykes, Perches, and Trouts of divers kinds: And that when the fifh afcend forth of the faid Loch, to the waters, burnes, andftrypes that fali in the fame to fpawn therein, There is great flaughter and deftruclion of them commited by the country people about, whereby the faid Loch and fifhing thereof is not of fuch worth to the heritors of the faid Loch, nor to the countrey about, as it would be if the faid fifties were not flain in the faid waters, burnes, andftrypes. For remedy whereof, his Majeftie, with advice and confent of the Eftates of this prefent Parliament, ftatutes and or- daines that none of his Majefties Lieges flay any Pyks, Perches, Trouts, or any other fifties in the wat- ers, ftrypes, or burns, that fall in the faid Loch, or run forth thereof, within the fpace of five miles to the faid Loch, under the paine of twentie pounds ufual money of this Realme, to be payed by each contraveen- er; teties quoties for each contravention; And ordaines die faid whole paines and unlawes of contravention toappertaine to the faidEarle of CMortOm, and his faid Son, their heiresand fucceflburs; And by thefe prefents gives and grants power and commiffion to them and their BaylifFes and Deputes, to call before them within thetowne of Kinrojcher, all perfons fufpeft of flaying of the faid fifli within the faid burnes, waters, Loch, or ftrypes, within thefaid fpace of five miles to the faid Loch; And as they Jhall be found guilty or innocent of flaying thereof, to aflbilyie them, or unlaw them in the unlawes forefaid; Andtodecerneand ordaine the perfons convict to pay the fame unlawes to the prodtor fifcal to be appointed for that erfed, by the faidEarle oiCHortoun, his faid fon, or their forefaids; And ordaines letters of horning upon a fimple charge of fix dayes, poynding, and other letters and executorials requifit to be direft for payment to the faidprodtour fifcal of the faid unlawes; And ordaines publication to bee made hereof, informeaseffeiris ACT XXX. Anent The Clan-Gregour, OUR SOVERAIGNE LORD, And three Eftates of this prefent Parliament, underftanding that albeit by the great care of his Highnes umwhile deareft Father of eternal memory, the Clan-Gregor was fuppreft and reduced to quietnefie; yet of late,they are broken forth againe to the heavie opprefllon of ma- ny of his Majefties good fubjecFs, who dwell near to the part where theyrefort, andfpeciallieinthesherif-' dome oCPerth, Sterling,Clackmannan, TAonteithJuennox, Angus, and Memes. Therefore,for the timous pre- venting of the diforder and opprefllon that may fall out by the faid name and Clan o{Mac-Gregour, and their! folIowers,and for farther fuppreffing of them; Ratifie and approve all Acts of Councei and Acts of Parliament made and granted heretofore, againft the faid wicked and rebellious Clan of Vlac-Gregour.
