It is alwayes Declared , that notwithftanding of this Act , any who have gotten or fhall get anynewInfeftmentofSuperioritie of Kirk-lands , the fame ihall ftand good, as to fuch VafTals who have given their confents to the faid right of Superioritie : In regard that fuch a confent , as to His Majeftie is of the nature of a Refignation of their propertie, in favours of the faid Superior , to beholden of the King. But prejudice nevertheleiTe to His Majeftie, of His Highnefle Right of Reverfion of the Few- ferm, Few-duties and Carnalities, conforme to the forefaid Act of Parliament, one thoufand fix hundred, and thirty three. o; LlV. lAcI in favours of Laick Tatrons, ofTro-veftries, Trehendries , Chaplanaries and Alter ages. UR SOVERAIGNE LORD, with advice and confent of His Eftates of parliament , Ratifies and Approves the Act of Parliament, made by King James the fixt, His Majefties Grand- Father of eternal memorie, Parliament firft , Chap, twelfth, Knent Trove [tries, Trebendries , Alterages, Chap- lanries , and Collegiat Kirks , pertaining to laick Patrons , together with the Act of Parliament twelfth Chap. one hundred and fifty eight , Ratifying the fame; and Ordaines the faids Acts to have full force and effect in all time coming ; with this Declaration alwayes , That in refpect the VafTals which held Lands of the faids Provefts , Prebendars , and others forefaids , are put to a great uncertainty of their Superiors , it not being known to them who are provided to the faids Proveftries , Prebendaries, Chaplanries, Alterages, and others forefaids,by reafon there is no publick Regifter,to the which theyjnay have recourfe for knowledge and notice thereof, and that the mod that they can know by any Regifter , is the Infeftments and Seizings , made to thofe who are laick Patrons holding of His Majeftie. Therefore , for fecuring of the VafTals , who hold Lands, Milnes, Fifhings, Tenements, Annual-rents or others whatfoever, of the faids Proveftries, Pre- bendaries, Collegiat Kirks, or of Chaplanries, Alterages, and others of that nature, at any time of before; It is Statute and Ordained , that the entry of the faids VafTals by Retour , Precept of Clare confiat , Refigna- tion, Comprifingor otherwayes whatfoever , fhall pertain to the laick-Patrons and their fucceffbrs, who ftand infeft in the faid laick-Parronages, holding immediatly of His Majeftie; and that the entry of the VafTals by them, fhall be as valid and fufficient to the faids VafTals , receivers thereof, as if they were entredbythe Titulars of the faids Proveftries , Prebendries , Alterages , Chaplanries , and others forefaids. And that the faids laick-Patrons, fhall be in all time coming in their place, as Superior to the faids Vaffals, and to have the fame power to give Infeftments to His Majefties Subjects , upon Retour or by precept of Clare conftat , or by Refignation, Comprifing, or any manner of way, with Gifts T)e novo damns * y and that without confent of perfons provided , or to be provided , to the faids Proveftries and prebend- aries of Collegiat Kirks , Alterages , Chaplanries, or other Titulars of Collegiat Kirks ; and alfo without confent of the Chapter or Convent of the faids prebendaries thereof, or moft part of the fame, which of before was in ufe and cuftom. Whereanent, and anent all Acts in the contrair, His Majeftie, with confent forefaid , difpences for ever , Referving alwayes to the Titulars of the faids Proveftries , Pre- bendaries , Alterages , Chaplanries , and others forefaids , the Fruits , Rents and Emof uments of the faids Proveftries , Prebendaries , and others forefaids , which are no wayes prejudged by this prefent Act. It is hereby further Statute and Ordained , with advice and confent forefaid , where there are any Prebendaries* Chaplanries, Alterages, or other foundations of that nature above-mentioned , founded, and fituated within any Burgh Royal of this Kingdom , that the Proveft , Baillies and Council of that Burgh ,where the fame are founded, are and fhall be in all time coming, only undoubted Superiors, by whom and by no others, the VafTals and Tennants fhall enter in manner above-fpecified; the faids Proveft, Baillies, and Council having been formerly Patrons of thefe Chaplanries .
