And be it further enacted, That the right of way, one hungwmgad at Pm}: dred feet in width, through the lands reserved west of the navy-yard, nicole for u mu- Pensacola, be, and the same is hereby, granted to Jasper Strong, George ‘“°"d· Tcrrill, and their associates, for the construction of a railroad from the Perdido River, on the most direct and practicable route, to the waters of Pensacola Bay, and the use of any timber, or other materials along the route of said road, and within a. half n mile on each side thereof} which may be necessary in the construction thereof; and at the terminus of said road on Pensacola Buy, the said Strong, Tcrrill, and their associates shall have the privilege of erecting a wharf and of establishing a depot for lumber, and other articles, not more than one acre in extent: Provided, said road shall be constructed on such line, and the terminus be at such point on Pensacola Bay, as shall be approved by the Navy Department: And provided, fm-ther, That this act shall not be so construed as to authorize said Strong, Tcrrill, and their associates, to use or destroy may timber which the Navy Department may direct to be preserved for navy purposes: And provided, further, That, in the opinion of the Secretary of Navy, the privileges conferred by this act will not be prejudicial to the public interest, or public property. m;‘;;<;;\;<>¤;z1‘#;¤;¤ Sec. 4.
