107 STAT. 2160 PUBLIC LAW 103-182—DEC. 8, 1993 19 USC 3461 SEC. 516. EFFECTIVE DATE. (a) IN GENERAL. —Except as provided in subsection (b), the provisions of this subtitle shall take effect on the date the Agreement enters into force with respect to the United States. (b) EXCEPTION.— Section 515 shall take effect on the date of the enactment of this Act. Subtitle C—Funding PART 1—CUSTOMS USER FEES SEC. S21. FEES FOR CERTAIN CUSTOMS SERVICES. (a) IN GENERAL.— Section 13031 of the Consolidated Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 58c) is amended— (1) by amending paragraph (5) of subsection (a) to read as follows* "(5)(A) For fiscal years 1994, 1995, 1996, and 1997, for the arrival of each passenger aboard a commercial vessel or commercial aircraft from outside the customs territory of the United States, $6.50. "(B) For fiscal year 1998 and each fiscal year thereafter, for the arrival of each jpassenger aboard a commercial vessel or commercial aircraft from a place outside the United States (other than a place referred to in subsection (b)(l)(A) of this section), $5." (2) by adding at the end of paragraph (1) of subsection (b), the folloMring flush sentence: "Subparagraph (A) shall not apply to fiscal years 1994, 1995, 1996, and 1997. ", (3) in subsection (f)— (A) in paragraph (1), by striking "except" and all that follows through the end period and inserting: "except— "(A) the portion of such fees that is required under paragraph (3) for the direct reimbursement of appropriations, and "(B) the portion of such fees that is determined by the Secretary to be excess fees under paragraph (5).", (B) in paragraph (3)(A), by striking the first parenthetical and inserting "(other than the fees under subsection (a)(9) and (10) and the excess fees determined by the Secretary under paragraph (5))", (C) in paragraph (4), by striking "under subsection (a)" and inserting under subsection (a) (other than the excess fees determined by the Secretary under paragraph (5))",and (D) by adding at the end thereof the following new paragraph: ^(5) At the close of each of fiscal years 1994, 1995, 1996, and 1997, the Secretary of the Treasury shall determine the amount of the fees collected under paragraph (5)(A) of subsection (a) for that fiscal year that exceeds the amount of such fees that would have been collected for such fiscal year if the fees that were in effect on the day before the effective date of this paragraph applied to such fiscal year.
