113 STAT. 868 PUBLIC LAW 106-65—OCT. 5, 1999 (g) DESCRIPTION OF PROPERTY. —The exact acreage and legal description of any real property conveyed under subsection (a), and of any easements, rights-of-way, or other interests granted under subsection (b), shall be determined by a survey or surveys satisfactory to the Secretary. The cost of the survey or surveys shall be borne by the Commonwealth. (h) ADDITIONAL TERMS AND CONDITIONS.— The Secretary may require such additional terms and conditions in connection with the conveyance of any real property under subsection (a) as the Secretary considers appropriate to protect the interests of the United States. PART III—AIR FORCE CONVEYANCES SEC. 2861. LAND CONVEYANCE, NEWINGTON DEFENSE FUEL SUPPLY POINT, NEW HAMPSHIRE. (a) CONVEYANCE AUTHORIZED.— The Secretary of the Air Force may convey, without consideration, to the Pease Development Authority, New Hampshire (in this section referred to as the "Authority"), all right, title, and interest of the United States in and to parcels of real property, together with any improvements thereon, consisting of approximately 10.26 acres and located in Newington, New Hampshire, the site of the Newington Defense Fuel Supply Point. (b) RELATED PIPELINE AND EASEMENT.— AS part of the convey- ance authorized by subsection (a), the Secretary may convey to the Authority, without consideration, all right, title, and interest of the United States in and to the following: (1) The pipeline approximately 1.25 miles in length that runs between the property authorized to be conveyed under subsection (a) and former Pease Air Force Base, New Hampshire, and any facilities and equipment related thereto. (2) An easement consisting of approximately 4.612 acres for purposes of activities relating to the pipeline. (c) CONDITION OF CONVEYANCE. —The conveyance authorized by subsection (a) may only be made if the Authority agrees to make the fuel supply pipeline available for use by the New Hampshire Air National Guard under terms and conditions acceptable to the Secretary. (d) DESCRIPTION OF PROPERTY.— The exact acreage and legal description of the real property to be conveyed under subsection (a), the easement to be conveyed under subsection (b)(2), and the pipeline to be conveyed under subsection (b)(1) shall be determined by surveys and other means satisfactory to the Secretary. The cost of any survey or other services performed at the direction of the Secretary under the preceding sentence shall be borne by the Authority. (e) ADDITIONAL TERMS AND CONDITIONS. — The Secretary may require such additional terms and conditions in connection with the conveyances under this section as the Secretary considers appropriate to protect the interests of the United States. SEC 2862. LAND CONVEYANCE, TYNDALL ADR FORCE BASE, FLORIDA.
