That it shall not be lawful to place, discharge, or deposit, by Deposits ps mms. any process or in any manner, ballast, refuse, dirt, ashes, cinders, mud, §;§g,;,QQ§}.,§jf"‘° "“‘ sand, dredgmgs, sludge, acid, or any other matter of any kind other than that flowing from streets, sewers, passing therefrom in a liquid state, in the waters of any harbor or river of the United States, for the improvement ofwhich moneyhas been appropriated by Congress, elsewhere than within the hmits defined and permitted by the Secretary ot War; neither shall it be lawful for any person or persons to move, 1mm,, ,0 jam,, destroy, or injure in any manner whatever any sea wall, bulkhead, jetty, M-- f·>¢bi¤¤i¤¤- dike, levee, wharf, pier, or other work built by the United States, in whole pr in part, for the presewpm and improvement of any of its naviga le waters, or to prevent s, or as boundary marks, tide gauges, surveying stations, buoys, or other established marks ; any and every such act is made a misdemeanor, and every person knowmgly engaged in or who shall knowingly aid, abet, authorize, or instigate a violation of this section shall, upon conviction, be punishable by fine or imprisonment, or both, such ine to be not less than two remitm. hundred and fifty dollars nor more than twenty-five hundred dollars, and the imprisonment to be not less than thirty days nor more than one year, either or both united, as the judge before whom conviction is obtained shall decide, one—l1alf of said fine to be paid to the person or persons giving information which shall lead to conviction of this misdemeanor. Any boat, vessel, scow or other craft used or employed in ,.,£‘f,l}€{,g§:iQ§tE’§€c°j violating any of the provisions of sections six and seven of this Act 1·¤>¤¤*>¤¤°¤•· shall he liable to the pecuniary penalites imposed thereby, and in addition thereto to the amount of the damages done by said boat, vessel, scow, or other craft, which latter sum shall be placed to the credit of the appropriation for the improvement of the harbor in which the damage occurred, and said boat, vessel, scow, or other craft may be proceeded against summarily by way of libel in any district court of the United States having jurisdiction thereof.
