CHAP. 290.-—Joint Resolution Authorizing the reappointment of Frederick Mears &Iu§.iliit?.i as a commimioned officer of the Regular Army and making him available, when soreap- pointed, for service as chairman and chief engineer of the Alaskan Engineering Commission. Resolved by the Senate and House of Re esentatives ty' the United States of America in Congress assembled, Tglat the President be, and isle-glggommmt of he is hereby, authorized, m his discretion and by and with the advice $°§g‘Q§m°:{j °° and consent of the Senate, to rea point Frederick Mears to the` i Regular Army in the ade and with the date of rank to which he would have been enthird at the time of such reappointment had he remained an officer of the Regular Army continuously from the time _ he first became an officer thereof : Provided, That after such reap- §{§’$,°§}“s,,;m_ pointment said Frederick Mears shall be regarded as having in contemplation of law the same status, rights, and privile es as an officer of the Regular Army that he would Siave had if he Sad remained a commissioned officer of the Regular Army continuously, xmder the various commissions in the Regular Army, issued to and accepted by him from the date of his first appointment therein. Sec. 2. That notwithstanding the provisions of sections 1222, 1224 (as amended by the Act of February 28, 1877, Nineteenth m*g’*j‘g‘}g;‘gs‘f*{’2';;°‘§g2, Statutes, pa e 243), 1763, 1764, and 1765, Revised Statutes, the 17Qr3—}7¢;~5,Pp-20Q: 0; provisions oig section 2 of the Act of July 31, 1894 (Twenty-eighth zs,g.`miEp§··ii3é9,`i»pZ tatutes, page 205), and the provisions of section 6 of the Act of mr582· May 10, 1916 (Thirty-ninth Statutes, e 120), as amended by the Act of August 29, 1916 (Thirty—mntlIi)arSgtatutes, page 582), or the ppovisions of other existing) statutes of like import, the said Frederick ears may, after having een rea pointed an officer of the Regular Army under the provisions of tliie preceding section, continue in omce under an existing commission as chairman and chief engineer of the Alaskan Engineering Commission or accept a new gippointment as such, and may exercise the functions of said ci office without pre`udice to his commission as an oiHcer of the Regular Army or to his standing as such, and ma receive the compensation duly prescribed from time to time for the incumbent of said civil office, less the ay and allowances to which he may be entitled as an officer of the lEi)egular Army.
