Be it enacted by the Senate and House of Representatives of the United States of America in Oongress assembled, That the Secre- tary of the Treasury is authorized and directed to pay to J. Edward Burke, out of any money in the Treasury not otherwise &ppropri- ated, the sum of $2,000, the amount of '" fine paid by J. Edward Burke in pursuance of a judgment entered upon a plea nolo contendere under certain provisions of the so-called Lever Act previous to the time that the Supreme Court of the United States held such pro- visions void, the said plea and said payment being made under a stipulation as follows: "In consideration that the Attorney General and this court shall acce{'t the plea nolo contendere which I hereby tender to the above-entitled indictment, I do hereby waive any and all fines which the court may see fit to impose upon me, upon such plea, except in the event that the so-called Lever Act under which. said indictment is found shall be declarp.d unconstitutional by the Supreme Court of the United States and that no prosecution could be sustained upon the facts .stated in said indictment."
