[Public, No. 648.] Be it enacted by the Senate and House of Representatives of the United States o f America in Congress assembled, That upon the com- pletion of the engineering investigation, study, and report to the Secre tary o f Stat e, as hereto fore a uthori zed by Publi c Reso lution Numbered 4, Seventy-fourth Congress, approved February 13, 1935, the Secretary of State, acting through the American Section, Inter- national Boundary Commission, United States and Mexico, in order to facilitate compliance with the convention between the United State s and Mexico concl uded M ay 21, 1906, provi ding f or the equi- Vol.34,p.2953. table division of the waters of the Rio Grande, and to properly regulate and control, to the fullest extent possible, the water supply for use in the two countries as provided by treaty, is authorized to construct, operate, and maintain, in substantial accordance with the engineering plan contained in said report, works for the canalization of the Rio Grande from the Caballo Reservoir site in New Mexico to the international dam near El Paso, Texas, and to acquire by donation, condemnation, or purchase such real and personal property as may be necessary therefor. SEC. 2. There is autho rized to be appr opriated the sum of $3,000,000 for the purposes of carrying out the provisions of section 1 hereof, other than for operation and maintenance, including salaries and wages, fees for professional services ; rents ; travel expenses ; per diem in lieu of actual subsistence ; printing and binding, law books, and books of reference : Provided, That the amount herein authorized to be appropriated shall include so much as may be necessary for com pletio n of c onstru ction of the diver sion d am in the Ri o Gran de wholly in the United States, in addition to the $1,000,000 authorized to be appropriated for this purpose by the Act of August 29, 1 935 (49 Stat . 961) : Provided further, That the total cost of construction of said diversio n dam and canalization works s hall not exceed $4,000,000 : Provided further, That the provisions of section 3709 of the Revised Statutes (U.S. C., title 41, sec. 5) shall not apply to any pu rch ase m ade or s erv ice procured whe n the aggregate amount involved is $100 or less ; purchase, exchange, maintenance, repair and operation of motor-propelled passenger- and freight-carrying vehicles ; hire with or without personal services, of work animals and animal-drawn and motor-propelled vehicles and equipment ; acquisi- tion by donation, condemnation, or purchase of real and personal property ; transportation (including drayage) of personal effects of employees upon change of station ; telephone, telegraphic, and air- mail communicati on ; rubber boots f or offic ial use by emplo yees ; i c e ; equipment, services, supplies, and materials and other such miscel- laneous expenses as the Secretary of State may deem n ecessary properly to carry out the provisions of the Act : And provided further, That any part of any ap propriation made hereunder may be transferred to, for direct expenditure by, the Department of the Rio Grande canaliza, tion project.
