Forfeitures . 75TH CONGRESS, 1sT SESSION-CH. 229-MAY 20, 1937 "(b) App rop ri ate certificates concerning the radio par tic ul ars prov ided for in said conv ention shal l be issued to a ny ves sel of the Uni ted S tates which is s ubject to t he rad io pr ovisi ons of the safety conve ntion and is found by the Com mission t o comply t herewith . Such certificates shall be issued by the Department of Commerce, or whatever other agency is authorized by law so to do, upon request of the Commission made after proper inspection or determination of the facts . If the holder of such certificate violates the provisions of the safety convention, or of this Act, or the rules, regulations, or con ditio ns pre scrib ed by the C ommis sion, and i f the effec tive admin- istration of the safety convention or of this part so requires, the Commission, after hearing in accordance with law, is authorized to request the modification or cancelation of such certificate . Upon receipt of such request the Department of Commerce, or whatever other agency is authorized by law to do so, shall modify or cancel the certificate in accord therewith . The Commission is authorized to issue, modify, or cancel such certificates in the event that no other agency is authorized to do so . "INSPECTIONS "SEC . 360 . (a) In addition to any other provisions required to be incl uded in a r adio statio n license, the station license of each ship o f the United States subject to this title shall include particulars with reference to the items specifically required by this title . "( b) Every ship of the United States, subject to this part, shall have the equipment and apparatus presc ribed therein, inspected at least once each year by the Commission . If, after such inspection, the Commission is satisfied that all relevant provisions of this Act and the station license have been complied with, that fact shall be certified to on the station license by the Commission . The Commis- sion shall make such additional inspec tions at frequent intervals as may be necessary to insure compliance with the requirements of this Act . "CONTROL. BY COMMISSION "SEC. 361 . Nothing in this title shall be interpreted as lessening in any degree the c ontrol of the Commission over all matters con- nected with the radio equipment and its operation on shipboard and its decision and determination in regard to the radio requirements, installations, or exemptions from prescribed radio requirements shall be final, sub ject only to review in accordance with law . "FORFEITURES "SEC. 36 2 . The follo wing forfei tures shal l appl y to this part, in addition to the penalties and forfeitures provided by title V of this Act "( a) Any ship that leaves or attempts to leave any harbor or port of t he United S tates in vi olation of the provisio ns of this part, or th e rules and regulations of the Commission made in pursuance thereof, or any ship of the United States that is navigated outside of any harbor or port in violation of any of the provisions of this part, or the rules and regulations of the Commission made in pursuance thereof, shall forfeit to the United States the sum of $500, recov- erable by way of suit or libel. Each such departure or attempted departure and in the case of a ship of the United States each day during which such navigation occurs shall constitute a separate offense .
