The foregoing provision shall not apply to quantitative regula- tions in whatever form imposed by the Government of the United States of America or by the Gov- ernment of the Republic of Peru on the importation or sale of any article the growth, produce or manufacture of the other country, in conjunction with governmental measures or measures under gov- ernmental authority operating to regulate or control the production, market supply, quality or prices of like domestic articles, or tend- ing to increase the labor costs of production of such articles, or to. maintain the exchange value of the currency of the country. Whenever the Government of the United States of America or the Government of the Republic of Peru proposes to impose or to alter substantially any quantita- tive regulation authorized by this paragraph, it shall give notice thereof in writing to the other Government and shall afford such other Government an opportunity to consult with it in respect of the proposed action, in accordance with the procedure provided for in article XI. 3. The provisions of paragraph 1 of this article shall not apply in respect of quantitative restric- tions imposed by the Government of the United States of America on imports of coffee from Peru pursuant to the provisions of the 6 Stat. 1143 . La disposici6n que antecede no se aplicara a las regulaciones cuantitativas impuestas en cual- quier forma por el Gobierno de los Estados Unidos de America o por el Gobietno de la Republica del Perd a la importaci6n o venta de cualquier artfculo cultivado, pro- ducido o manufacturado en el otro pais, en conjunci6n con medidas gubernativas o medidas dictadas con autorizaci6n gubernativa des- tinadas a regular o controlar la producci6n, el abastecimiento del mercado, calidad o los precios de articulos nacionales similares, o tendientes a aumentar el costo de la mano de obra en la producci6n de tales articulos, o a mantener el valor de cambio de la moneda del pafs. Cuando el Gobierno de los Estados Unidos de America o el Gobierno de la Republica del Perd se proponga imponer o al- terar sustancialmente cualquiera regulaci6n cuantitativa autorizada por este parrafo, lo comunicara por escrito al otro Gobierno y dar& a este la oportunidad de consultarse con 61 con respecto a la proyectada acci6n, de acuerdo con el procedimiento establecido en el artfculo XI. 3. Las disposiciones del parrafo 1 de este artfculo no se aplicaran a las restricciones cuantitativas impuestas por el Gobierno de los Estados Unidos de America a la importaci6n de caf6 proveniente del Peri, en conformidad con las estipulaciones del Convenio Inter- Americano del Cafe firmado el 28 de noviembre de 1940, o las de cualquier otro convenio interna- cional.
