SIR: I have the honor to refer to the negotiations which have taken place between the Government of the Republic of Nicaragua and the Government of the United States of America relating to the Agree- ment between the two Governments which was signed in Washington on May 22, 1941 for the detail of an officer of the United States Army 55 tat . 1327- to serve as Director of the Military Academy of the National Guard of Nicaragua. Circumstances having made it impracticable for final action to be taken, in accordance with Article 4 of the Agreement of May 22, 1941, prior to the termination of the period specified in Article 3 of the Agreement, I have the honor, under instructions from my Govern- ment, to inform you that in accord with the conversations which have taken place in regard to this matter it is the desire and the understand- ing of my Government that the Agreement of May 22, 1941 shall be and is considered to have continued in force on and after May 22, 1943, notwithstanding the provisions of Article 4 of that Agreemlent. It is likewise the desire of, and it is proposed by, my Government that the Agreement of May 22, 1941 continue in force for a further period of two years commencing May 22, 1943, with the understanding, however, that the provisions of Articles 5 and 6 thereof with respect to methods of termination or cancellation shall be applicable. I shall be glad to have you inform me whether the Government of the United States of America'is in agreement with the understanding and proposal mentioned above. If the Government of the United States of America concurs, this agreement will be considered by the Government of the Republic of Nicaragua to be effective as of May 22, 1943.
