CIVIL PROCEDURE.
CHAPTER 8.
AN ACT TO ESTABLISH A CODE OF CIVIL PROCEDURE.
Be it enacted by the Legislative Assembly of the Territory of Dakota:
PRELIMINARY PROVISIONS.
Style of act.Section 1. This act shall be known as the code of civil procedure of the Territory of Dakota.
Rule of construction.Sect. 2. The rule of the common law, that statutes in derogation thereof, are to be strictly construed, has no application to this code. Its provisions, and all proceedings under it, shall be liberally construed, with a view to promote its object, and assist the parties in obtaining justice.
