It is hereby ordered that sections 35 and 30 of township 16 south, range 13 west, and the north half of the northeast quarter of section 1, the north half of the northwest quarter of section 2, the southwest quarter of the northwest quarter of section 11, and the north half of the northwest quarter of section 12 of township 17 south, range 13 west, all lying north of the military reservation of Fort Bayard, New Mexico, and within the limits of the Gila National Forest as established by Proclamation of the President of July 21, 1905, be further withdrawn from sale or other disposition for military purposes to protect the water supply of Fort Bayard: Provided, That this withdrawal for use by the War Department shall not revoke the withdrawal of the land as apart of the Gila National Forest made by the Proclamation of July 21, 1905, but both withdrawals shall stand together, the withdrawal for the War Department being the dominant one, and whenever the use of the land as a National Forest does not interfere with the protection of the water supply of Fort Bayard, such use shall not be interfered with, but the lands shall not be subject to appropriation under any of the public land laws: And provided, further, That this order of withdrawal shall become operative as to section 36 of township 16 south, range 13 west, only in the event of the selection by the Territory of New Mexico, or by the State to be created to include said Territory, of other lands in lieu of said section 36.
