EXECUTIVE ORDER NO. 18

WHEREAS, the services provided by the several state agencies are relied upon by the citizens of the state and the maintenance and effective functioning of those services is in the public interest;

WHEREAS, due to retirements such agencies require some period for a transition that allows for the recruitment and training of replacement personnel or other arrangements that will facilitate the maintenance of important programs or functions;

WHEREAS, the temporary worker retiree program ("TWR"), codified in Sec. 5-164a of the Connecticut General Statutes, as amended by the Pension Award, and administered by the Department of Administrative Services, provides for temporary employment of state retirees for periods not to exceed 120 days per calendar year in cases where such employment is cost effective and facilitates the maintenance of important programs or services;

WHEREAS, the TWR program aids state agencies in maintaining a proficient and efficient workforce during a period of transition;

WHEREAS, the TWR program plays an important role in the transition plans of several state agencies as they cope with the effects of retirements;

WHEREAS, certain efficiencies and budgetary savings can be realized from the practice of employing retired state employees when managed appropriately;

WHEREAS, the winter of 2010 - 2011 brought with it record snowfalls and treacherous driving conditions and it is appropriate for the state to prepare adequately for similar conditions in the winter seasons to come;

WHEREAS, because of the driver training necessary to properly and safely operate the state’s snow removal equipment, the state Department of Transportation will achieve efficiencies and budgetary savings by temporarily employing retired state employees during the winter season to supplement its snow removal and emergency services;

WHEREAS, Executive Order 27-A, dated October 22, 2009, limited the parameters for approval of an individual under the TWR program;

NOW, THEREFORE, I, Dannel P. Malloy, Governor of the State of Connecticut, by virtue of the authority vested in me by the Constitution and Statutes of the State of Connecticut, do hereby ORDER AND DIRECT:

1. Nothing in Executive Order 27-A, dated October 22, 2009, shall prevent a member of the state retirement system who has twice been approved for and took part in the TWR program and who is otherwise eligible to take part in such program from being approved in accordance with the provisions of paragraph 2 hereof.

2. The Commissioner of the Department of Transportation may request an exception to the requirements of items 1 and 4 of Executive Order 27-A from the Commissioner of Administrative Services for retirees who provide services necessary for snow removal and emergency operations functions during the snow season from November through April. Such exceptions may be granted if there is an insufficient pool of temporary worker retirees who have worked less than the two 120-day periods. The working period of the temporary worker retirees under this exception shall not exceed 120 days in a calendar year nor work more than four calendar years.

3. The provisions of this order shall apply to any new or renewed employment that is effective on or after the effective date of this order.

4. Executive Order 27-A, dated October 22, 2009, is hereby amended with the text hereof.

This order shall take effect immediately.
