such proceedings to be so published as soon after any meeting of the commissioners as practicable, and the board of county commissioners shall pay at the rate of twenty-five cents per square of twelve lines of solid brevier type or its equivalent, to each newspaper designated to publish such proceedings which shall file or cause to be filed with the county clerk or auditor an affidavit of publication executed in proper form; provided, that not more than two newspapers in any congressional township shall be so designated, and when there are but two papers in a county, and both are in the same congressional township, the commissioners shall designate but one of such papers; and provided further, that in case there shall be no newspaper pub- lished in their respective counties, then the board of county commissioners shall cause such proceedings to be published in such other newspaper in the territory as shall be printed nearest to the county seat of their respective counties; and shall also cause such report to be posted in three public places within their respective counties, one of which places shall be the office of the county clerk.

§ 620. It is hereby made the duty of the county clerk to make out a full and complete report of the proceedings of each regular and special meeting of the board, and to transmit the same to the publishers of the newspapers selected by such board to publish such proceedings, said report to be made out and transmitted by such clerk within one week from the time such proceedings are had. Such clerk shall be allowed by the board a reasonable compensation for such service.

§ 621. It shall be the duty of the publisher of any newspaper selected to publish any proceedings of the board of commissioners of the several counties, to cause any proceedings as aforesaid received by him from any county clerk, to be published in the issue of his paper next succeeding the time of their reception.

Board may purchase Melville's justice court practice. s. 1 and 2, c. 87, 1885.

§ 622. The county board of each county in the territory of Dakota, is hereby authorized to purchase for each justice of the peace in their respective counties, at a price not exceeding five dollars per volume, one copy of the Dakota Justice Court Practice, Civil and Criminal," prepared, copy-righted and published by Americus B. Melville. Whenever any county board shall purchase and receive one or more of said books, the chairman of said board, together with the county clerk, shall sign a warrant of the county in an amount equal to the price agreed to be paid for said books, and shall deliver the same on demand to the publisher.

§ 624. The register of deeds shall keep a full and true record, in proper books kept for that purpose, of all deeds, mortgages, bills of sale, chattel mortgages and all other instruments authorized by law to be admitted to record, filed with him for that purpose, provided the person so filing them for record shall first pay him the fees provided by law for recording the same. When an instrument is filed with him for record he shall indorse thereon
