be privileged from prosecution under the provisions of said Section 2 upon any matter inquired of him when so testifying.

Section 5. All Acts and parts of Acts in conflict with the provisions of this Act are hereby repealed.

Section 6. This Act shall take effect and be in force from and after its passage.

AN ACT

To Amend Paragraph 2453, of Title XXI of the Revised Statutes of Arizona, 1901.

Be it Enacted by the Legislative Assembly of the Territory of Arizona:

Section 1. That Paragraph 2453 of Title XXI of the Revised Statutes of Arizona, 1901, be and the same is hereby amended so as to read as follows:

2453. (Section 10) All proceedings under this Act must be brought in the District Court for the County in which the property is situated. They must be commenced by filing a complaint and issuing a summons thereon. In any action now pending or that may hereafter be brought under this title, the plaintiff may, at the time of filing his complaint, or at any time thereafter, make application to the court, or the judge thereof in vacation, for an order permitting such plaintiff to take possession of, and use the property sought to be condemned for the purpose as prayed for.
