1. This Order may be cited as “ The Palestine Prize Court (Fees) Order in Council, 1940.”

2. The Rules of Court mentioned in the schedule hereto are approved.

SCHEDULE

The Prize Court (Fees) Rules, 1940, made by the Chief Justice of Palestine on the 18th day of January, 1940, and approved by the High Commissioner on the 20th day of January, 1940, under Article 49 of the Palestine Order in Council, 1922, and published in the Palestine Gazette of the 22nd day of January, 1940.

ORDER IN COUNCIL amending article 12 of.“ The Alien Order, 1920.”—London, May 17, 1940([1])

At the Court at Buckingham Palace, the 17th day of May, 1940

PRESENT: THE KING’S MOST EXCELLENT MAJESTY IN COUNCIL

His Majesty, in pursuance of section 1 of “The Aliens Restriction Act, 1914,”([2]) as amended by any subsequent enact ment, and by any provision of “ The Defence (General) Regulations, 1939,”([3]), and of all other powers enabling him in that behalf, is pleased, by and with the advice of his Privy Council to order, and it is hereby ordered, as follows :—

1. This Order may be cited as “The Aliens Order, 1940.”

2. After paragraph (5) of Article 12 of “ The Aliens Order 1920,”([4]) there shall be inserted the folowing paragraph—

“(5A) Where a deportation order has been made with respect to any alien, and, in the opinion of the Secretary of State—

(a) the deportation of the alien would be impracticable or prejudicial to the efficient prosecution of any war in which His Majesty may be engaged, and

(b) the detention of the alien is necessary or expedient for securing the public safety, the defence of the realm, or the maintenance of public order,
