(a) the taking of possession or acquisition is necessary in the interests of defence, public safety, public order, public morality, public health, town and country plan- ning or the development or utilization of that or other property in such a manner as to promote the benefit of the public generally or of the inhabitants generally of a particular area; and (b) provision is made by a written law applicable to that taking of possession or acquisition- (i) for the payment of proper compensation within a reasonable time; and (ii) securing to any person claiming to have an interest in or right over the property a right of access to a court or other adjudicating authority for the determination of his interest or right, if any, the legality of the taking of possession or acquisition of the property, interest or right, and the amount of any compensation to which he is entitled, and for the purpose of obtaining payment of that com- pensation within a reasonable time. (3) If, in any proceedings by virtue of section 80, it is alleged that the condition specified in paragraph (a) of subsection (2) of this section is not satisfied and a certificate in writing is produced to the court signed by a Minister of the Government of Rhodesia that in the opinion of that Minister the taking of pos- session or acquisition is necessary on such of the grounds men- tioned in the said paragraph (a) as is specified in the certificate, it shall be deemed to be so necessary unless the court decides as the result of hearing the complainant that, in the circumstances of the case, it would not be reasonable to accept without proof to the satisfaction of the court the necessity of the taking of possession or acquisition on the grounds stated in the certificate. (4) Nothing in this section shall be construed as affecting the making or operation of any law so far as it provides for the taking of possession of, or the acquisition of any interest in or right over, property- (a) in satisfaction of any tax, rate or due; (b) by way of penalty for breach of any law (including any African customary law) whether under civil process or after conviction of an offence; (c) upon the attempted removal of the property in question out of or into Rhodesia in contravention of any law;
