These titles were conferred upon Anne, Duchess of Sutherland, o. dau. of John Hay Mackenzie, of Newhall and Cromartie, and heir through female descent of the 3rd Earl of Cromartie (whose honours and estates were forfeited for participation in the rising of 1745), and under the special limitations in the patent devolved upon her second son, the late Earl, and the heirs of his body. It was contended by him that under the limitations of the patent the peerage, shovild he die without issue male, would devolve upon his eldest dau., the present Countess, but on his death in 1893, the peerage was considered to have fallen into abeyance, which was terminated by letters patent in 1895 in favour of the present Countess.
