On the 2nd s., then Baron Buckhurst, becoming the 7th Earl De La Warr it was referred to the House of Lords to decide whether the 3rd s. could by this shifting clause claim the Barony of Buck- hurst, and that tribunal gave their decision in 1876 in favour of the title remaining with the 2nd s., and thus eonibined with the title of De La Warr.
