Dr Brunner (Grundzüge der deutschen Rechtsgeschichte, 1901, p. 216) has lately said that Roman jurisprudence 'auch wenn sie nicht geradezu bäuernfeindlich war, doch kein Verständnis besass für die Mannigfaltigkeit der bäuerlichen Besitzformen des deutschen Rechtes.'
