"The Constitution of Georgia requires the Judges to write out their Decisions, and have them entered on the minutes of the Court. The Reports in Georgia are collections of those Decisions, and as each Judge is independent of the others in his own Circuit, the Decisions are not very consistent with each other. Indeed the Decisions from the same Circuit cannot be uniform, as the Judge is invariably turned out of office at the end of four years, if his party happens to be in the minority in the legislature. Thus what is law in one Circuit, may not be law in the Circuit adjoining ; and what is law in a Circuit this year, may not be law in the same Circuit next year." See Georgia Decisions, post. The Penal Code of Georgia. 1817. T. U. P. Charlton, while Judge of the Eastern Circuit of Georgia, in the case of State v. Calvin, et al., thus speaks of this Penal Code — " We felt anxious to adopt the criminal law of our ancestors to the republican institutions of this country, and with that feeling as the pole star of the duty confided to us, we endeavored to place the accused upon as high a scale of dignity as was dictated by the wide difference between a citizen of a republic and the subject of a monarchy. .We consequently infused into that system (which the legislature of Georgia did us the honor to adopt) every principle of mercy and indulgence which that contrast suofffested."
