ITEM, Whereas feveral Perfons do often fue Af- fifes of Novel dijfeifin before Juftices affigned againft divers Perfons, and by Craft and Collulion, to have their Writs of their laid Aflifes directed to the Coroners of the Counties where the Tenements be, to make Execution of the faid Writs, do name in their faid Aflifes the Sheriff of the fame County one of the Diffeifors, where he is not, neither ever was Diffeifor or Tenant of the Tenements in De- mand, whereby oftentimes the faid Aflifes be award- ed by the Default of the Tenants which have no Knowledge of thofe Aflifes, for that they found not any Aflife againft them in the File of the Sheriff, nor have any Suspicion of any fuch Aflife taken againft the Sheriff' and them j" ' (2) our Lord the King, willing in this Cafe to provide Remedy, of the Aflent and Authority aforefaid, hath ordained, That in all fuch Aflifes purchafed, at this Time de- pending, or hereafter to be purchafed, between any Perfons whatfover they be, before any fuch Juftices, in which Aflifes any fuch Sheriff is named Dif- feifor, if the Tenants in the faid Aflifes or any of them will aver, that the faid Sheriff is not, nor ever was, Diffeifor, nor Tenant of the Tenements in Demand, but was named Diffeifor by Collufion, the Averment fhall be received. (3) And if it be found by the faid Aflife, that the faid Sheriff is not, nor ever was, Diffeifor nor Tenant of the Tenements in Demand, but was named Diffeifor by Collufion, then the faid Juftices fhall caufe to be abated and quafhed the faid Writ purchafed, or to be purchafed in the Form above-faid ; (4) and that the Plaintiffs or Plaintiff" be in the grievous Mercy of the King.'
