Bailiff, or otherneadOfJu of the County, City or Town Corporate ; (5) which faid Juftice or ocher Head Officer lhall have Power, by Force of this Statute, to miriifter the faid Oath, where the Offence Ihall be committed, or the Paity offending apprehended ; (6j ihall give the Party and Parties fuch Recommence and Satisl. their Damages, and within fuch lime, as by.any on- fuch Justice of Peace of the fai 1 County when fuch Offence fhall be done, without the Liberty of any City or' Town Corporate, or by fuch Head Officer or Juftice of Peace within any City or Town Corporate, flia.ll be ordered and appointed, and the fame to be only for the firit Fault : (7) And if fuch Offender or Offenders fhall be thought in the Difcretion of the faid Juftice or Jutlices, or other Head Officers, not able or fufficient, or do not make Recompence or Satisfac- tion for the' faid Damages, in Manner and Form aforefaid; Then the faid Juftice or Head Officer dull commit all and every the laid Offender or Offenders to fome Conftable or Constables, or o her inferior Offi- cers of the City, Borough, Town or Hamlet, where the Offence thai, be committed, or the Party ap] hended, to be whipped ; (8) and for every fuch Offence, for or of which die Offender 01 O eftfoons committed in Form afore limited, the Perfon and Perfons fo offending, to receive the laid Punilh- ment of Whipping.
