(c) and if any fuch Common Brewer or Retailer fliall refufe to permit any fuch Gager or Gagers to en- 'ter his Brewhoufe, or any other Place afore-mentioned, or to gage or take Account of his Brewng- Veflels, or of any fuch B.eer, Ale, Worts, Perry, Cyder, Strong Water, Aqua-vitce, Metheglin. or other the Liquors aforefaid, fuch Brewer, Retailer or Diftiller Ihail be forthwith forbidden by the faid iGager or Gagers to fell, carry out or deliver to any of his Cuftomers any Beer, Ale, Strong W, ter, ' Aqua-vita ■> or other the Liquors aforefaid ; (6) And if any fuch Brewer, Retailer or Diftiller of any the JLiquors aforefaid, after fuch Warning given, ihall fell, cany or deliver out ther fame, or any Part the: eof, inot having paid and cleared the Duty of Excife, fuch Perfon and Perfons ihall, befides the Forfeiture of idouble the Value, forfeit and lofe the Sura of five Pounds, as aforefaid, for every Offence, to be le ied iand recovered upon his or their Goods and Chattels in Manner and Form as hereafter in this A6t is XX. And for the avoiding of all Incertainty and Difpute touching the Returns made or to be what (hall be made by the Gagers of any Beer or Ale fo brewed as aforefaid; (2) Be it enadted and declared by reckoned a Bar- the Authority aforefaid. That every fix and thirty Gallons of Beer taken by the Gage according to the relofBeer. Standard of the Ale Quart, four whereof fliall make the Gallon, remaining in the Cuftody of the Chamberlains of his Majefl:y's Exchequer, ihall be reckoned, accounted and returned by the Gager for a Barrel of Beer; and every two and thirty Gallons of Ale taken by the Gage according to the iame '^^^ ^^"*'°^ Standard, fhall be in like Manner reckoned, accounted and returned for a Barrel of Ale; and all other ihe Liquors aforefaid according to the Wine Gallon. XXL Provided always, and be it enadted and ordained by the Authority aforefaid, That no Brew- irs or Retailers of Beer and Ale fliall take any more in the Price thereof, upon Sale of the fame, than according to the ufual Rates and Prices : Saving that every Common Brewer fhall and may take and receive of all and every Perfon and Perfons to whom he (hall fell and deliver any Ale or Beer, the Excif© thereupon due as aforefaid, over and above the ufual Rates and Prices. XXIL And be it enadfed by the Authority aforefaid, That for the better Encouragement of all Common Brewers and Makers of Beer or Ale to make due Entry and Payment thereof according as by this Aft is appointed, the faid Common Brewer not felling the (ame by Retail, for and in Confideration af Wai^e by Fillings and Leakage of their Beer and Ale, (hall have and be allowed out of the faid Re- Abatements and" turns-made by the Gagers the feveral Allowances and Abatements hereafter-mentioned, (that is to fay) Allowance to be upon every three and twenty Barrels of Beer, whether ftrong or fmall, returned by the faid Gagers, madefor WMie three Barrels ; and upon every two and twenty Barrels of Ale, whether ftrong or fmall, returned by the*" *^ ^^*' Gawers two Barrels ; which faid Allowances and Abatements the faid Commiflioners to be appointed as jaforefaid, and their Sub-CommiiTioners, are hereby authorized to allow and make accordingly. r XXIII. Provided always. That where any Common Brewer (hall wittingly or willingly make a falfe Forfeiture for Entry, and be convifted for the fame before the CommiiRoners to be appointed as aforefaid, or any two '*"* Entries, of than or before fuch other Perfon or Perfons as are hereafter by this Adt appointed, in that Cafe Ifuch Brewer or Brewers (liall forfeit and lofe, over and befides the Penalties before-mentioned, the faid (Allowance fo to be made for fix Months then next enfuing. XXIV. And be it enadted and ordained by the Authority aforefaid. Provided always, That if any Perfon or Perfons (hall brew and fell by Retail any fmall Quanti- Beer and Ale- •ties of Beer or Ale in any Fair within this Realm or Dominions aforefaid, who is not otherwife any com- fold in Fairs.- W)n or ufual Brewer or Retailer thereof, and fliall before any fuch Selling and Retailing thereof. Well and itruly pay and fatisfy the Duty due for the fame to the Coinmilfioners or Sub-Commilhoners within whofe il/imits or Divifions the fame Fair (hall be held, or to their Officers thereunto appointed ; That then fuch Perfon or Perfons fo brewing or retailing the fame, and for fo much and no more, nor otherwife, fhall be (freed and difcharged from all Penalties and Forfeitures in and by this Adt beforeinentioned and impofed ;, 'any Thing therein contained to the contrary notwithftanding. XXVI. Provided neverthelefs.
