An Aft to prevent the unlavsrful Courling, Hunting or Killing of Deer. v FO R the better Preventing of the unlawful Courfing, Hurting, Taking or Killing of Deer, hif many idle, loofe and diforderly Perfons, (2) Be it enafted by the King's moft Excellent Majefty, and by the Advice and Confent of the Lords and Commons in Parliament afTembled, and by the Au- thority of the fame, That if any Perfon or Perfons fhall from and after the firft: Day of Augisfl next Mt)r lawfully courfe, kill, hurt or take away any Red or Fallow Deer in any Foreft, Chafe, Purlieu, Pad- dock, Wood, Park or other Ground where Deer are or have been ufually kept within the Realm tifi England or Dominion of Wales, without the Confent of the Owner or Perfon chiefly intrufted with thei Cuftody thereof, or fliall be aiding or afTifcing therein, and fhall be convifted thereof by the Confefficm. of the Party, or by the Oath of one or more credilsle WitnelTes, before one or more Juftices of t| Peace, (who are hereby impowered to adminifter an Oath to that Purpofc) fuch Perfon being profecuti for fuch Offence within fix Miaiths after fuch Offence done ; that then every Perfon fo offending, fhj forfeit for every fuch Offence the Sum of twenty Pounds; (3) to be levied by Way of Diftrefs up^ the Goods and Chattels of every fuch Offender, by Warrant under the Juftices Hand before whoS fuch Conviftion (hall be made ; (a) the one Moiety of the faid twenty Pounds to be given to tfctel Informer, and the other Moiety to the Owner of the Deer ; (5) and for want of fufficient Diftrefs, thel Offender fhall be committed to the Houfe of Correftion for fix Months, and there to be put to hardi Labour; or to the Common Gaol for one whole Year, without Bail or fv'Iainprife, at the Difcretion df the Juftices of the Peace before whom fuch Conviftion fliall be (and not to be difcharged from thenpfe till he or they have given fufficient Sureties for their good Behaviour for one whole Year next enfuing after liis or their Inlargement : ) (6) Provided, That where any Offender fhall be punifhed by Foretf 4 of
