Penalty. 6alt Officers to 5W.&M, S, II. c. 7- be made thereof within ten Days after his firft coming into fuch Port, and the Duties paid down or f-~ cured for the fame, before the fame, or any Part thereof, fhall be landed or taken out of any fuch Ship or Veffel, in the fame Manner as the Duties of foreign Salt imported are to bz paid or fecured ;. any thing in this A(St or any other Statute to the contrary notwithftanding. VII. And be it further enadled by the Authority aforefaid, That from and after the faiJ firft Diy of jfu>ie one thoufand feven hundred and four, no Salt fhall be brought out of Scot/and by Land, into any rart' of England, or Town of Berwick upon Tweed, or Precinfts thereof, on Pain of forfeiting the Salt fo brought into any of the faid Places, and twenty Ihillings a Bufhel, and fo proportionably for a greaier or leffer Quantity ; and that it ihall and may be lawful to and for any of the Officers for the Duties upon Salt, to feize any Salt fo brought into any of the faid Places, and to apprehend the Perfon and Perfons feize fuch Salt, -yfY^Q fhall bring in the fame, and to carry him, her, or them before any of her Majefty's Juftices of the ^ Peace near the Place where fuch Seizure fhall be made ; and if, upon full Proof of the Fact, fuch Ofieuder /hall not pay down the faid Penalties by this Act impofed, fuch Juftice fhall commit fuch Offender to the next Gaol, there to remain for the Space of fix Months without Bail or Mainprize. ' VIII, And whereas by an Adl of Parliament made in the filth Year of the Reign of the late Kir., ' William and Queen Mary, intituled, An Acl for granting to their Adajejlies certain Rates aiid Dut I ' upon Salt, and upon Beer, Ale, and other Liquors, for fecuring certain Recompences and Advantages^ in tl . ' Jaid A5i mentioned, to fuch Perfons as fjall voluntarily advance the Sum of ten hundred thoufand Founds, to ' wards carrying an the War agaiijl France ; it is amongft other Things enafted, That no Salt fhall be ' delivered from any Salt V/orks or Pits, without Notice firft given to the Officer appointed for that ' Purpofe, upon Pain of Forfeiture of the Salt fo delivered, and upon Pain of twenty Pounds to be for- ' feited by the Owner or Owners of the Salt Works or Pits, where fuch Salt fliall be delivered : And ' whereas feveral Salt Makers have been, and others may be, fubje£l:ed to the faid Penalties of twenty ' Pounds, by the evil PraSices of Salt Carriers, and others, who convey Salt from the Salt Works with- ' out a Warrant or Permit for conveying the fame ;' For preventing whereof be it enaiSed by the Au- Penalty on Salt thority aforefaid. That from and after the faid firft Day of June one thoufand feven hundred and four, a& Cariier carrying ^gjj jj^g Carrier, or Perfon who fhall carry or convey any Salt without a Warrant or Permit for carrying Salt without a ^^ {-iLmt, as the Proprietor of the Salt Works, who fhall deliver Salt without Notice fij-ft given, fhall forfeit the faid Sum of twenty Pounds, ' IX. And whereas in and by the faid Aft of Parliament made in the fifth Year of the Reign of the late ' King William and Queen Mary, and by feveral other Afts relating to the faid Duties upon Salt; ' it is amongft other Things provided, That any Perfon, who fhall export beyond the Seas any Salt, as ' well foreign as Englijh, or any Rock Salt, fhall, upon a Debentnre made out according to the Direc- ' tion of the faid A£ts, be repaid the Duties of fuch Salt fo exported : And whereas fome Doubts and ' , Controverfies have been made, whether Salt fhipped and exported to Scotland, the Ifle oi Man, or the ' Iflands of Jerfey and Guernfey, be an Exportation of Salt within the Intent and Meaning of the faid ' A6fs, fo as to intitle the Exporter to a Drawback of the Duties of the Salt fo exported :' For prevent- Salt exportea to jj^g of all fuch Controverfies and Difputes, be it enadled and declared by the Authority aforefaid. That it of Man'^'Ir Ter- '^^^ ^^"^ '^ ^^^ Intent and Meaning of the faid Aifts, that any Perfon exporting any 'Salt to Scotland, the fey and'cuei-n-' ^^^ of Man, or the Iflands of Jerfey and Guernfey, according to the Diredfions of the faid A<Sts, is and fhall be intitled to a Drawback of the Duties of the Salt fo exported, and fhall be repaid the fame, ia- fuch Manner, and under fuch Conditions, as are direfted and required by the faid A&s, in cafe of the Exportation of Salt to any other foreign Parts ; any thing in the faid A6ts or any other Law or Statute t» the contrary in any wife notwithftanding. Double Coiis. fand feven hundred and four, be ftiipped or laid on board any Ship or VefTel, in any Port, River, or Place within this Kingdom of England, or the Dominion of Wales, or Town oi Berwick upon Tweed, m. order to be exported to Parts beyond the Seas, or be carried Coaftwife ; and the faid Salt or Rock Salt, fa fliipped or laid on board, fhall happen to perifh by the finking of the Ship or VefTel, on which the fame fhall be fhipped or laid on board, before the faid Ship or VefTel fhall go out of fuch Port or Place, and before the Exporter of fuch Salt {hall be intitlf 2 to a Drawback or Allowance of the Duties thereof; then and in fuch Cafe the Exporter or Proprietor of the faid Salt or Rock Salt, fo periflied, fhall, upon Proof made before the Juftices of the Peace, at the next General Quarter-Seffions of the Peace, to be held for the County, City, Riding, Divifion, or Place next to the Place where the faid Salt or Rock Salt fhall h perifh, of the Lofs of the Salt or Rock Salt fo fhipped, receive from the faid Seffions a Certificate, th-at fuch Proof was made before them, and upon producing the faid Certificate to any of her Majefty's Col- lectors or Officers apjpointed to colleft the faid Duties on Salt, the faid Collectors and Officers are hereby required to let the faid Exporter or Proprietor buy the like Quantity of Salt or Rock Salt, as is exprelTed in the faid Certificate to be fo perifhed, without paying to her Majefty any Duty of Excife for the fame, in the fame Manner as if fuch Salt or Rock Salt had fo perifhed going Coaftwife from one Port of England to another. XI. Provided always, and be it further enafted. That if any Perfon or Perfons fhall at any Time be fued or profecuted for any thing by him or them done or executed in purluance of this ASt, he or they fhall or may plead the General IfTue, and give this Aft in Evidence for his Defence ; and if upon a Trial a Verdift fhall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs be nonfuit, difcontinue, or forbear proiecuting the faid Aftions, then fuch Defendant or Defendants fiaali have double Cofis to I hin;
