J Ann*, flat. 1 nth All Reflories impropriate the Tythes, &c. vefted in Truf- tees by II & 32 W. 3. c. 2. and fincc reftored to any Perfom, &c. contrary to In- tent of Aft of Parliament, fuch Perfons to be di- vefted thereof; &c. and the fnme fettled in .Wil- liam Neave, S.-C. hundred and ninety-nine, for the Space of twenty Years thence next enfaing, in rebuilding or repair- ing fuch Parifh Churches within the faid Kingdom o{ Ireland, as the Lords Juftices, Lieutenant General, or other chief Governor or Governors of the faid Kingdom for the time being, by and with the Advice and Confent of the Bifhop of each refpedive Diocefe for the time being, fliould direft or appoint; and after the Expiration of the faid Term of twenty Years, for the perpetual Augmentation of fuch fmajf Re<5):ories and Vicaridges within the faid Kingdom of Ireland, as the faid Lords Juftices, or other chief Governors of the faid Kingdom, by any Writing under his or their Hands and Seals, with Confent of the Eifhop of each Diocefe, v>'herein any fuch Augmentation fliould be made, fhould direft or appoint ; which Appointments fhould before the twenty-fifth Day of March one thoufand feven hundred and three, be made and inrclled in the Court of Chancery in Ireland, as a perpetual Memorial thereof: And for making the fame more effectual and beneficial for the pious Ends and Purpofes aforefaid, one other Acl: paffed in the firft Year of her Majefty's Reign, intituled, Jn ASi for making more effeStual the Pro- •uifton out of the forfeited Ejlates in Ireland, /or the building of Churches, and augmenting fmall Vicaridges in Ireland ; whereby it is enacted. That where any fuch Redtories impropriate, Tythes, Advowfons, or othe/ 1 hings fo vefled in the faid Truftees, and direfted to be conveyed in Truft as aforefaid, were charged with, or liable to any Debts, Charges or Incumbrances, jointly with any other Lands, Tene- ments or Hereditaments, by the faid Adt velted in the faid Truftees, fuch other Lands, Tenements or Hereditaments in the firft Place fhould be liable to, and fhould anfwer and fatisfy fuch Debts, Charges and Incumbrances ; and the faid Truflees, or any feven of them, were thereby authorized and required to make Sale of fuch other Lands, Tenements or Hereditaments, or of a competent Part thereof, for or towards the paying off, clearing and difcharging fuch Debts, Charges and Incumbrances ; and as foon as conveniently might bej from and after fuch Sale, and the clearing and difcharging fuch Debts and Incumbrances, fuch P.edfories impropriate, Tythes, Advowfons, and other Things fo veiled in the faid Truftees, and direfted to be conveyed in Truft as aforefaid, as were, together with fuch other Lands, Tenements or Hereditaments, jointly charged or incumbred, fhould be conveyed, and the faid Truftees, or any feven of them, were thereby authorized and required to convey the fame to fuch Per- fon and Perfons, and in fuch Manner, and to fuch Ufes, Intents and Purpofes, as in the faid firft re- cited A£t is directed and appointed, freed and difcharged of and from all fuch Debts, Charges and In- cum.brances, be the fame by Matter of Record, Mortgage, or otherwife : And whereas the faid Truf- tees, according to the Powers given to them, did convey the faid Rectories impropriate, with the Tythes, Oblations, Obventions, Glebes, Advowfons, Vicaridges, and other things thereunto feverally and refpectively belonging or appertaining as aforefaid, to William Neave Efquire, one of her Majefty's Serjeants at Law in Ireland, Marmaduke Coghill and Morley Saunders, Doctors of Law, Samuel Dapping, John UJher snd Stephen Ludlow Efquires, their Heirs, Executors, Adminiftrators and AfKgns, for the Purpofes in the faid firft Act mentioned : And whereas by feveral fubfequent Acts of Parliament paffeJ fince the making the faid ftrft recited Act, divers Parts of the faid forfeited and other Eftates and Inte- refts by the faid firft Act vefted in the faid Truftees, have been given, granted, or reftored to feveral Perfons, and for feveral Ufes, Intents and Purpofes in fuch fubfequent Acts mentioned, in the paffing of all which fubfequent Acts it was intended that no Perfon or Perfons was or were, by any fuch fub- fequent Act of Parliament, in which any Claufe or Provifion was made or inferted for or in favour Qf the faid Church of Ireland, to be reftored, or to have, by any fuch Act of Parliament, any Right, Title or Ihtereft into or out of any of the faid Rectories impropriate. Tithes, Oblations, Obventions, Glebes, Advowfons, Vicaridges, or other things thereunto refpectively belonging or appertaining, aa aforefaid, but that they fhould remain, continue, and be in the faid Truftees in the faid firft recited Act named, to and for the Ufes and Purpofes therein mentioned : And whereas it was likewife intended that fufHcient Provifion fhould be made in every fuch fubfequent Act of Parliament for that Purpofe, and fe- veral Claufes and Provifoes were refpectively inferted in every fuch fubfequent Act and Acts ; neverthe- lefs feveral Doubts, Suits and Controverfies relating thereunto have arifen, whereby the Church reaps little or no Benefit by the faid firft recited Acts ;' For Remedy whereof, and for making the faid in- tended Gift of Parliament more effectual for the pious Ends and Purpofes mentioned in the faid firft re- cited Act, be it declared and enacted by the Queen's moft Excellent Majefty, by and with the Advice' and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affem- bled, and by the Authority of the fame. That all and every the Rectories impropriate, with the Tythes, Oblations, Obventions, Glebes, and Advowfons of Vicaridges, and other things thereunto feverally and refpectively belonging or appertaining, which in and by the faid firft recited Act were vefted in the faid Truftees therein mentioned as aforefaid, and which in and by any of the faid fubfequent Ail or Adts of Parliament paffed in favour of any Perfon or Perfons, in which any exprefs Provifion or Claufe fs. contained in favour of the faid Church oi Ireland, were any ways given, granted or reftored, contrary to the Ufes, Intents and Purpofes in the faid firft recited A£ts mentioned, be, and is, and are hereby diverted out of fuch Perfon and Perfons, and of and from all the Ufes, Intents and'Purpofes in fuch fubfequent Afts mentioned, in which any fuch Provifion is made in favour of the faid Church q^ Ireland, and be arid are hereby vefted and fettled in the faid William Neave, Marmaduke Coghill, Morley Saunders, Samuel Dap- ping, John JJflisr, and Stephen Ludlow, their Heirs, Executors, Adminiftrators and Affigns, according to the feveral Eftates and Interefts vefted in the faid Truftees by the faid firft recited Aft appointed, to fuch Ufes, Intents and Purpofes, as therein mentioned, as fully and amply as if the fame had been referved' I out of, or not given, granted, or reftored by the faid fubfequent A£t or Atts of Parliament, or as if fuch fubfequent Aft or Afts of Parliament, in which any Claufe or Provifion in favour of the Church oi Ire- land is inferted, and not otherwife» had never been made and enafted, n.
