C. 9. 395 made by the Exporter before the faid Cuftomer or Colle£lor of the Port (who is hereby alfo authorized and required to adminifter the fame, without Fee or Charge) that the Candles fo exported are the fame mentioned in the faid Certificate; then the faid Cuftomer or Collector of the Port wheic fuch Candles fliall be exported, fhall give to the Exporter thereof a Debenture evpreffing the- true Qiiantity of the Can- dles fo exported; which Debenture being produced to the Colleftor appointed to receive the faid Duties upon Candles, in fuch County or Place where the faid Candles were exported, he fhall forthwith pay the faid Duty which {hall have been received upon this Aft, to the Perfons or Agents fo exporting the fame; and if fuch Colleftor fhall not have Money in his Hands to pay the fame, then the faid refpcftive Com- miffioners of Excife are hereby recjuired to pay the faid Debenture out of the Duties upon Candles arifing by this Aft, or if the Duty of fuch Candles fo exported were only fecured, and fliall remain unpaid, then the fame {hall be difcharged upon the Securities for the fame; any Thing in this Aft contained to the contrary notvvithftanding. An ASi for ^asa UedTo iakino aiuav the Court of Wards mul Liveries^ and Tenures In Capite, and by Knights Service, and Purveyance., ^<^^^Y>Mys ' ' and for fettling a Revenue upon his Majefy in lieu thereof, or by any other Law now in Force relating to her Majefty's Revenue of Excife upon Beer, Ale, or other Liquors, are provided, fettled, or eftablifhed, for managing, raifing, levying, collefting, mitigating, or recovering, adjudging, or afcertaining the Du- ties thereby granted, or any of them (other than in fuch Cafes for which other Penalties or Provifions are made and prefcribed by this Aft) fliall be exercifed, praftifed, applied, ufed, and put in Execution, in and for the managing, raifing, levying, collefting, mitigating, recovering, and paying the faid Duties upon Candles hereby granted, during the Continuance of this Aft, as fully and efteftually, to all Intents and Purpofes, as if all and every the faid Powers, Authorities, Rules, Direftions, Methods, Penalties, Forfeitures, Claufes, Matters and Things, were particularly repeated, and again enafted in the Body of this prefent Aft. XXVIII. And be it further enafted by the Authority aforefaid. That all Fines, Penalties, and For- pines, &c. how feitures, in relation to the faid Duties by this Aft impofed upon Candles, fhall be fued for, levied, and to be recovered, recovered, or mitigated, by fuch Ways, Rdeans, and Methods, as any Fine, Penalty, or Forfeiture is or may be recovered or mitigated, by any Law or Laws of Excife, or by Aftion of Debt, Bill, Plaint, or Information, in any of her Majefty's Courts of Record at JVeJhninJler, or in the Court of Exchequer in Scotland; and that one Moiety of every fuch Fine, Penalty, and Forfeiture {hall be to her Majefty, her Heirs and Succeffors, and the other Moiety to him or them that {liall difcover, inform, or fue for the fame. ' XXIX. And whereas Candles are, or often may be cracked, or fpoiled in making, and unfit for Sale;' Candles fpolled it is hereby provided and enafted. That upon {hewing the fame to the Officer appointed for charging the to be defacedj&c. faid Duties upon Candles, fuch Officer {hall quite deface fuch cracked or fpoiled Candles, and make an Allowance of the Duty hereby chargeable for the Candles fo by him utterly defaced; any Thing herein contained to the contrary notv/ithftanding.
