CAP. XII. An A<5t for preventing of Frauds and Ahufes in the Allowances on damaged Wines, and for lengthening the Time for the Drawbacks on the Exportation of Wines. I. ^T 7HEREAS by the tenth Rule annexed to an Act of Parliament paffed in the twelfth Year of' 2 Car. 2. -.. 4 V V the Reign of his late Majefry King Charles the Second, intituled, A Sulfuly granted to the King of Tonnage and Poundage, and other Sums of Money payable upon Merchandize exported and imported, which ' has been continued by feveral fubfequent Acts, and is now in Force, it is provided, That if any Wines r > Ed. 1. <■. r-51 fhall prove corrupt and unmerchantable, and fit for nothing but to diftil into hot Waters, or to make *'J^£'?' Charge to the Merchant, by Certificate, or that the Quantity of Wine fo ftaved, fpilt or otherwife de-^ 28 - k ^°" ftroyed, be deducted from the Foot of the Account of the Merchant refufing to pay or fecure the Du^'j^, ™'^ of fuch Wine, as aforefaid, in the Book or Books kept by the proper Officer or Officers appointed to the damagea wines, Difcharge of the Ship importing the Wine. &c. IV. And be it further enacted, That over and above the Duties repaid or allowed, as aforefaid, the Mer- Compenfation to chant or other Perfon fhall, _ for every Ton of Wine, containing two hundred fifty and two Gallons, of the J^p 1 ™^, °J Growth of Germany, or Wines which pay Duties as fuch, and of the Growth of France, fo ftaved, fpilt ^y iix '"d ftaved. or otherwife destroyed, be allowed as a Compenfation for the Freight and other Charges, the Sum of four Pounds; and Wines of the Growth of Spain, Portugal, and elfewhere, the Sum of eight Pounds per Ton, and fo in proportion for any greater or lefler Quantity, which Allowances fhall without Delay be paid by Certificate out of the Duties arifing by the faid Act of Tonnage and Poundage, and the Officers are hereby required and directed to make, pafs, and pay fuch Certificate -without Fee or Reward, V.
