'unlefs the Owner thereof ihall make it appear, that fuch Increafe was made either by mixing fome of his Stock of Britijh Spirits, whereof the Officer ofExcife had taken an Account, with his foreign Brandy, Spirts or Strong Waters in the Prefence of the Officer of Excife of the Divifion where the faid Increale (hall be found, or by foreign Brandy, Spirits or Strong Waters brought into the Place where fuch In- creafe fhall be found, with a Permit or Certificate of the Payment of the Duties thereof, or that the fame had been formerly condemned, or was Part of fome Perfon's Stock in Hand on the firft Day of Augujl one thoufand feven hundred and twenty, and that due Notice was given to the Officer of Excife at the faid Divifion of the bringing in the fame, before the fame was fo brought in. ' XIII. And whereas many Retailers of foreign Brandy, Spirits or Strong Waters are furnifhed with the Brandy, Spirits or Strong Waters which they retail, by Perfons who run the fame, or their Accom- plices, in fmall Quantities, viz. lefs than one Gallon at a Time, and when the Officers of the Excife find fuch fmall Quantities in the Hands of fuch Retailers, they refufe to produce any Permit or Certi- ficate for the fame, alledging, that no fuch Permit or Certificate are required by Law for any Quantity I' of fuch Brandy, Spirits or Strong Waters under the Quantity of one Gallon, whereby the Runners ' thereof find Means to difpofe of great Quantities of fuch run Brandy, Spirits or Strong Waters:' For Remedy whereof, Be it enacted by the Authority aforefaid, That from and after the faid twenty-fifth Day Foreign Brandy, of March one thoufand feven hundred and twenty-two no foreign Brandy, Spirits or Strong Waters, al- tho' lefs than one though the fame be under the Quantity of one Gallon, fhall be received or taken into the Cuftody or Pof- G aI1 °"> * lthou * feffion of any fuch Retailer, or any Perfon or Perfons for the Ufe of any fuch Retailer, without a Permit fJted withCafo" or Certificate figned by fome Officer of the Cuftoms or Excife, fignifying that the Duties thereof were paid, or fecured to be paid, or that the fame had been condemned as forfeited, or was Part of fome Per- fon's Stock in Hand on the firft Day of Augujl one thoufand feven hundred and twenty ; upon Pain of for- I feiting all fuch foreign Brandy, Spirits or Strong Waters, as fhall be fo found in the Cuftody of fuch Re- tailer or any other Perfon or Perfons for the Ufe of any fuch Retailer, without a Permit or Certificate,

together with the Cafk, Bottle or other VefTel wherein the fame fliall be fo found ; any Law, Statute or

Provifion to the contrary thereof in any wife notwithstanding. ' XIV. And whereas by Virtue of an A£f. palled in the Seffion of Parliament holden in the feventh 7 Geo. 1. (tat. 1. I ' Year of his Majefty's Reign, obliging all fuch Ships, Perfons and Goods coming from Places that are or c - 3- EXP - ' fhall be mentioned in his Majefty's Proclamation, to perform Quarentine, it is enacted, That in cafe 2 6.Geo. 2. c 6.

  • any Commander, Mafter or other Perfon taking Charge of any Ship liable to perform Quarentine fhall 27 gv*. 2. c. 1%.
  • not, within convenient Time, after due Notice given for that Purpofe by the proper Officer, caufe fuch 29 Geo. 2. c. 8.
  • Ship or VefTel, and the Lading thereof, to perform Quarentine refpeftively, then fuch Ship or VefTel 33 Set. z, c. 16.
  • is forfeited, and the Commander, Mafter or other Perfon as aforefaid forfeits two hundred Pounds : And

' whereas the Commanders, Mafters or other Perfons taking Charge of fuch Ships or Veilels do pretend

  • after they are put into the Place or Places to perform Quarentine, to be bound to Parts beyond Seas,

' or fome other Port or Place of this Kingdom, and do frequently depart from fuch Places without the

  • Licence of the proper Officer appointed to fee the Quarentine duly performed, contrary to the true In-
  • tent and Meaning of the faid Act :' For Remedy whereof, Be it enacted and declared by the Authority

aforefaid, That if the Commander, Mafter or other Perfon taking Charge of any Ship or VefTel liable to sh; depart ; ng perform Quarentine, fliall depart with or permit or fuffer fuch Ship or VefTel to depart from the Place without Licence or Places appointed for the Performance of Quarentine, without Leave or Licence of the proper Officer fromPlaces a P - or Officers appointed to fee the fame performed, fuch Ship or Vefli.1, with her Tackle, Furniture and P ointed for Qii*- Apparel, fhall he forfeited to his Majefty, his Heirs and SuccefTors, and the Commander, Mafter or other "nt.ne forfeited, Perfon as aforefaid, fhall alfo forfeit the Sum of two hundred Pounds ; one Moiety thereof to the Ufe of iTli Commu- nis Majefty, his Heirs and SuccefTors, and the other Moiety thereof to the Informer or Profecutor. ders, &c. to for- feit 200 1.
