' try thereof flia.II have been made, and the Duty by the aforefaid Acts granted and continued fhall have ' been paid, has been found too fmall to prevent the clandeitine Importation of the fame : And whereas ' by the low Price that Hops have taken and do ftill bear in foreign Markets, great Quantities of foreign ' Hops are imported into and vended in Great Britain, and brought into and vended in Ireland, contiary ' to Law ; ' For preventing therefore of a Practice lb prejudicial to the Hop Planters of this Kingdom, and lb detrimental to the Revenue; Be it enacted by the King's molt Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prelent Parliament afiembled, and by the Authority of the fame, That from and after the firft Day of May which fhall be After 1 May in the Year of our Lord one thoufand feven hundred and thirty-four, if any foreign Hops fhall be landed 2734, for ?'? 1 . or put on Shore out of any Ship or Veffel in Great Britain, before due Entry thereof fhall be made at the G °| a s t Britain'"/ Cuftom-houfe in the Port or Place where the fame fhall be imported, and before the Duties charged or Ireland, before chargeable thereon fhall be paid, or without a Warrant for landing or delivering the fame firft figned by Entry and Pay- the CommilTioners, Collector or other proper Officer or Officers of the Cuftoms reflectively ; or if ™ C n S ned War-' any foreign Hops, other than of Britijh Growth, lhall be landed or put on Shore out of any Ship or rant, Veffel in Ireland, all fuch Hops, of what Kind foever, as fhall be fo landed or put on Shore, or taken out of any Ship or Veffel in Great Britain or Ireland, lhall be forfeited and burnt within ten Days after the fhailbe burnt, fame fhall be lawfully condemned, and alfo the Ship or Veffel forfeited in which the fame were impo ted, ^ p forfelN and the Perfon or Perfons concerned in importing of the fame, or that fhall have been aiding and affiiting and importer to in the landing or putting the fame on Shore, fhall forfeit and pay the Sum of five Shillings for every Pound P a >' 5J- f ?', e, ^ h Weight thereof; and fo in Proportion for any greater or leffer Quantity. £°"™ of fuch II. And be it further enacted by the Authority aforefaid, That the feveral Fines, Penalties and For- Penalties how feitures, as well fpecifick as pecuniary, by this Act impofed (the fuing for, levying and recovering of t0 be levied,, which are not hereby before particularly provided for) fhall and may be fued for, levied and recovered, or mitigated, in Great Britain or Ireland reflectively, by fuch Ways, Means and Methods, as any Fine, Penalty and Forfeiture may be fued for, levied, recovered or mitigated, by the Laws now in Force rela- ting to Hops ; and that one Moiety of every fuch Fine, Penalty and Forfeiture fhall be to his Majefty, his Heirs and Succeffors, and the other Moiety to him or them that will difcover, inform or fue for the fame. CAP. XX. An A<5t for the more eafy E.edernption and Foreclofure of Mortgages. 'HER E AS Mortgagees frequently bring Actions of Ejectment for the Recovery of Lands and 4©" $w.& 3& Eftates to them mortgaged, and bring Actions on Bonds given by Mortgagors to pay the Money c - * 6 ' ' fecured by fuch Mortgages, and for performing the Covenants therein contained, and likewife com- ' tnence Suits in his Alajefty's Courts of Equity, to foreclofe their Mortgagors from redeeming their 4 Eftates ; and the Courts of Law, where fuch Ejectments are brought, have not Power to compel fuch ' Mortgagees to accept the principal Monies and Ihterefts due on fuch Mortgages, and Cofts, or to ftay ' fuch Mortgagees from proceeding to judgment and Execution in fuch Actions ; but fuch Mortgagors ' mult have Recourfe to a Court of Equity for that Purpofe ; in which Cafe likewife the Courts of ' Equity do not give Relief until the Hearing of the Caufe : For Remedy thereof, and to obviate all Objections relating to the fame ; Be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the firft Day of Eafter Term one After tHe-fTrff thoufand feven hundred and thirty-four, where any Action fhall be brought on any Bond for Payment of ^ ayof Eafter the Money fecured by fuch Mortgage, or Performance of tire Covenants therein contained, or where Anions? 4 ' i cpn- any Action of Ejectment lhall be brought in any of his Majefty's Courts of Record at Wejlminjler,. or ceming- More- in the Court of Great Seffions in Wales, or in any of the fuperior Courts in j»he Counties Palatine of g a 5 e s<"" Ejects' Chejler, Lantajler or Durham, by any Mortgagee or Mortgagees, his, her or their Heirs, Executors, * Adminiftrators or AfTigns, for the Recovery of the Poffeffion of any mortgaged Lands, Tenements of Hereditaments*
