And to prevent any Difpute relating to the Authority of any Perfon or Perfons acting as an Perfons qu.iii- Officer, or as Officers of the Cuftoms, Excife or Salt-duties in Great Britain or Ireland, for the putting ^a in jsxecul' in Execution this Act, or any other Act or Acts of Parliament relating to thofe Revenues, or made tion. againft the Tranfportation of Wooll ; Be it further enacted by the Authority aforefaid, That every Perfon, who by Deputation, CommiiTion or other Inftrument, under the Hands and Seals of the Commiffioners of the Cuftoms, Excife or Salt, in Great Britain or Ireland reflectively, (hall be ap- pointed to act as an Officer or Servant under them, for putting this or any of" the faid Acts in Ex- ecution, fliall be efteemed an Officer of the Cuftoms, Excife or Salt refpe&ively, to all Intents and Purpofes in the Law whatfoever. XXV. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons what- 3 ool. Penalty foever Thall offer or promife to give any Bribe, Recompence or Reward whatfoever, to any Officer £ n -,° fferi Q 5 ffi to e . or Officers of the Cuftoms, Excife or Salt in Great Britain or Ireland, to connive at or permit the " ean Tranfportation or the Concealment of any Wooll, Wooll- flocks, Wooll-fells, Mortlings, Shortlings, Yarn, made of Wooll, Cruels or Wooll flightly manufactured, or Mattrafles or Beds fluffed with combed Wooll, or Wooll fit for combing, Fullers-earth, Fullers-clay, and Tobacco-pipe-clay, or any other fcouring Earth or Clay ; or to the removing thereof, contrary to this or any other Act made againft the Tranfportation thereof; or to do, conceal or connive at any other Act, whereby any of the Provifions made by this or any other Law as aforefaid may be evaded or broken ; every fuch Perfon and Perfons lhall for every fuch Offence (whether the fame Offer, Propofal or Promife be accepted or performed or not) forfeit the Sum of three hundred Pounds, to be recovered and applied to the Ufe of him or them who fhall inform or fue for the fame by Action of Debt, Bill, Plaint or Information, in any of His Majefty's Courts of Record at Wejhninjler, or in the Court of Exchequer in Scotland, or in any of His Majefty's Courts of Record at Dublin; wherein no Effoin, Protection or Wager of Law, or any more than one Imparlance fhall be allowed. XXVI. And for the more effectual putting this Act in Execution, Be it further enacted by the Au- Perfons oppo- thority aforefaid, That if any Officer or Officers of the Cuftoms, Excife or Salt, or any other Per- {jj'efr^'ur'y" m fon or Perfons that (hall act in Aid or Affiftance of any Officer or Officers of the Cuftoms, Excife deemed Felons. or Salt, in putting this Act in Execution, (hall be hindered, oppofed, obftructed, molefted, wound- ed or beaten, in feizing any Wooll, Wooll-fells, Wooll-flocks, Mortlings, Shortlings, Woollen or Bay Yarn, or any other Species of Goods before enumerated, by any Perfon or Perfons whatfoever, either in the Day or Night, by Land or Water; the Perfon or Perfons that fhall fo hinder, oppofe, obftruct, moleft, wound, or beat any fuch Officer or Officers, or any Perfon or Perfons who fhall act in his or their Aid or Affiftance in the making fuch Seizures as aforefaid ; or any other Perfon or Perfons what- foever, being armed with offenfive Arms or Weapons, or wearing any Vizard, Mafk, or other Dif- guife, who fhall refcue or attempt to refcue any Wooll or other the Goods aforefaid, which fliall be feized by any Officer or Officers of the Cuftoms, Excife or Salt ; every fuch Perfon or Perfons that fliall be convicted of any of the faid Offences fliall, by Order of the Court before whom fuch Of- fender or Offenders fhall be convicted, be tranfported to fome of His Majefty's Colonies and Plan- tations in America, for fuch Term as fuch Coutt fhall think fit, not exceeding feven Years, in the fame Manner as by an act made in the fourth Year of the Reign of His late Majefty King George 4 Geo. 1. c. u. the Firft, of glorious Memory, intituled, An At! for the further preventing Robbery, Burglary, and other Felonies, and far the. more ejfeclual Tranfportation of Felons, and unlawful Exporters of Wooll-, and for .declaring the Law upon fome Points relating to Pirates; and by one other Act made in the fixth Year 6 Geo. 1. c. 23. of the Reign of His late Majefty, intituled, An Act for the preventing Robbery and other Felonies, and for the more ejfeclual Tranfportation of Felons, the Offenders therein mentioned are to be tranfported to the faid Colonies and Plantations ; and if any fuch Offender or Offenders fhall return into Great Bri- tain, or Ireland, before the Expiration of the Time for which fuch Perfon lhall be tranfported, con- ■ trary to the Intent and Meaning hereof, he or they fo returning fhall fuffer as Felons, and have Execution awarded againft them as Perfons attainted of Felony, without Benefit of Clergy. ' XXVII. And whereas by an Act paffed in the fourth Year of his late Majefty King George 4 Geo. 1. c.u. ' the Firft, intituled, An Ail for the further preventing Robbery, Burglary, a?id other Felonies, and for ' the more effectual Tran/portation of Felons, and unlawful Exporters of Wooll, and for declaring the Law 1 upon fome Points relating to Pirates, it is enacted, That if any Perfon or Perfons fhall be in Prifon

  • for want of fufficient Bail, for unlawful Exportation of Wool] or Wooll-fells, and fliall refufe to

' appear or plead to a Declaration or Information to be delivered to fuch Perfon or Perfons, or to 4 the Gaoler, Keeper or Turnkey of the Prifon, at the faid Prifon, for the faid Offence, by the Space ' of one Term, Judgment fhall be entered againft him by Default ; and in cafe Judgment fliall be ob- ' tained againft any fuch Perfon or Perfons by Default, Verdiit or otherwife, and fuch Perfon or Perfons ' lhall not pay the Sum recovered againft himor themfor thefaid Offence within the Space of three Months '* after entering up of fuch Judgment, the Court before whom fuch Judgment lhall be obtained, (hall by ' Order of Court caufe fuch Offender or Offenders to be tranfported in the fame Manner as Felons a- ' forefaid, for the Term of feven Years ; and if fuch Offender or Offenders fhall return into Gnat Bri- V0L..VI.
