And be it further enacted by the Authority aforefaid, That the Sum of twenty-one thoufand Pounds one Shilling and eight pence halfpenny, remaining in the Receipt of his Majefty's Exche- quer, arifen by Sale of the Lands in the Illand of Saint Chri/fopher's, (hall and may be iffued and applied as Part of the Supply granted to his Majefty for the Service of the Year one thoufand (even hundred and forty; any Law, Statute or Provifion to the contrary in any wife notwithstanding, o- the faid Sum IV. And it is hereby enacted by the Authority aforefaid, That in cafe the faid Commiffioners of may be raifed by n j s Maieftv's Treafury, or any three or more of them, or the high Treafurer for the time beine, (hall quej- BiJls. think it adviteable to raiie the (aid bum 01 one million two hundred thoufand Ppun.is, or any Part thereof, by Loans or Exchequer Bdls, in Manner hereafter mentioned, that it fhall and may be lawful to and for any Perfon or Perfons, Natives or Foreigners, Bodies Politick or Corporate, to advance or Lnd to his Majefty, at the Receipt of his Majefty's Exchequer, any Sum or Sums of Money, ntft exceeding the faid Sum of one million two hundred thoufand Pounds, upon the Credit of the Sur- pluffes, Excefles and Overplus Monies, commonly called The Sinking Fund; and to have and receive tor the Forbearance of the Money lent, Intereft after a Rate not exceeding three Pounds ten Shillings per Centum per Annum, lb as fuch Loans be allowed to be made by the faid Commiflioners of the Treafury, or any three or more of them now being, or the high Treafurer, or any three of the Commiffioners of t e Treafury for the time being, who are hereby authorized to ifTue their Warrants for that Pur- pofe, as faft as fuch Loans lhall be wanted tor the publick Service; and moreover, that no Money to be lent upon the Security of this Act (hall be rated and affefTed to any Tax or Affeffment whatfoever. And be it further enacled, That all and every Perfon and Perfons who lhall lend any Money Tallies and or- upon the Credit of this Act as aforefaid, and pay the fame'mto the Receipt of the Exchequer, lhall im- deH - mediately have a Tally of Loan itruck for the fame, and an Order for his, her or their Repayment, bearing the fame Date with his, her or their Tally, in or upon which Order lhall be alio contained a v Warrant for Payment of Intereft for the Forbearance thereof, not exceeding the faid Rate of three Pounds ten Shillings per Centum per Annum, and to be paid every three iVlonths, until the Repay- OrHers and merit of the Principal; and all fuch Orders for Repayment of Money fo to be lent (hall be regiftred Payments to bs in Coarfe according to the Dates reflectively; and that all and every Perfon and Perfons fhall be paid in courfe. j n Courle, according as their Orders (hall ftand regiftred in the faid Regilter Books, fo as the Perfon or Perfons, Na ives or Foreigners, his, her or thc.r Executors, Administrators or Affigns, who (hall have his, her or their Order or Orders fi: ft entred in the faid Books of Remitter, (hah be taken and accounted to be the tirft Perfon or Perlons to be paid cut of the faid Surplufles, Exceffes and Overplus Monies; and he, (he trthey, who (hall have his, her or their Order or Orders next entred, ihaij be taken and accounted to be the fecond Perfon to be paid, and fo fucceffively and in Courfe; and that the Monies to come in of or for the faid Surpluffes, Exceffes and Overplus Monies, commonly called The Sinking Fund as aforefaid, fhall be in the fame Order liable to the Satisfaction of the faid refpective Perfons, and Body or Bodies Politick or Corporate, their Executors, Adminiftrators, Succeffors or Al- No undue Pre- figns reflectively, without undue Preference of one before another, and not otherwife; and (hall not be ference. diverted or di'vertihle to any other Ufe, Intent, or Purpofe whatfoever, other than fuch Ufes and Pur- officers to take pofes as are appointed by any other A6t or A6ts of Parliament in that Behalf as aforefaid; and that no no Fees. Fee, Reward, or Gratuity, direiily or indirectly, lhall be demanded or taken of any of his Majefty's Subje6ts, for providing or making of any fuch Books or Regifters, or any Entries, Views, or Searches in or for Pa ment of Money lent, or the Intereft thereof, as aforefaid, by any of his Majefty's Officer or - Pennies. Officers, their Clerks, or Deputies, on Pain of Payment of treble Damages to the Party grieved by the Party offending, with full Celts of Suit; or if the Officer himielf take or demand any fuch Pee or Re- ward, then to lofe his Place alfo; and it any undue Preference of one before another ill =11 be made either in Point of Regiltry or Payment contrary to the true Meaning of this Act by any fuch Officer or Officers, then the Party offending (hall be liable by Action of Debt, or on the Cafe, to pay the 4.
