C. 19. 451 ceipt of Exchequer, for anfwering the faid Annuities to be purchafed upon this Act, after the faid Rare of three Pounds per Centum per Annum, fhall by Order of the Commimoners pf his Majefty's Treafury, or any three or more of them now being, or of the High Treafurer, or Commifiioncrs of the Treafury of his Majefty, his Heirs and SuccefTors for the Time being, without any further or other Warrant to •fued for, had or obtained in that Behalf, be from Time to Time half yearly as aforcfaid, illued and paid ,3t the faid Receipt of Exchequer, to the faid firft or chief Cafhier or Cafhiers of the faid Governor and Company of the Bank of England, and of their Succeffors for the Time being, by way of Impreft, an i upon Account of the Payment of the faid Annuities to be purchafed upon this Act:, at fuch Times, and in fuch Manner and Form as are by this Aft prefcribed in that Behalf; and that all and every fuch Ca- fhier and Cafhiers, to whom the faid Monies fhall from time, to time be iflued, fhall from time to time without Delay, apply and pay the fame accordingly, and render his Accounts thereof according to the due Courfe of the Exchequer; any Thing herein contained to the contrary notwithftanding. VI. And it is hereby alfo enacted, That the faid Accomptant General for the Time being, fhall from The Bufir.efs of time to time infpect and examine all the Receipts and Payments of the faid Cafhier or Cafhiers, and the the Accomptant Vouchers relating thereunto, in order to prevent any Fraud, Negligence or Delay; and that all and every general. Perfon and Perfons whatfoever, who fhall be intitled to any of the faid Annuities, after the Rate of three Pounds per Centum per Annum, and all Perfons lawfully claiming under them, fhall be poffeffed thereof as of a Perfonal Eftate, and the fame fhall not be defcendable to the Heir, and fhall not be liable to any foreign Attachment by the Cuftom of London, or otherwifej any Law, Statute, or Cuftom to the con- trary notwithftanding. VII. And for the Encouragement of the Contributors to advance and pay readily to the faid Cafhier or Cafhiers the Sums by them intended to be advanced upon this Act; it is hereby provided and enacted by the Authority aforefaid, That every fuch Contributor who fhall advance and pay to the faid Cafhier or Cafhiers within the Times limited by this Ad, the Purchafe Money payable for an Annuity or An- nuities at the Rate aforefaid, his, her or their Executors, Adminiftrators, Succeffors and Affigns refpec- tively, fhall be allowed and paid out of the Contribution-money arifing by this Act, Intereft after the Rate of four Pounds per Centum per Annum, for prompt Payment of the Purchafe Money, or of fuch 4 1 - per Cent, for Proportions of the Purchafe Money, as fhall be advanced before the faid fixth Day of July one thoufand P rom Pt Pa y- feven hundred and forty-two, or before any other the refpective Days of Payment appointed by this Act meat " as aforefaid; the faid Intereft to be computed for the refpective Sums fo advanced and paid to the faid Ca- fhier or Cafhiers, from the Time or lrr refpective Times of the actual advancing and paying the fame to the faid Cafhier, until the faid refpective Days of Payment appointed by this Act as aforefaid. VIII. And be it further enacted by the Authority aforefaid, That all the Monies to be advanced or The Money con- contributed upon this Act, for or towards the faid Sum, not exceeding eight hundred thoufand Pounds, c" b?uf Stock * jlhall be deemed, reputed, and taken to be one Capital or Joint Stock, on which the faid Annuities, apl a after the Rate of three Pounds per Centum per Annum, fhall be attending; and that all and every Perfon and Perfons and Corporations whatfoever, in Proportion to the Money, by him, her or them advanced upon this Act, fhall have and be deemed to have an Intereft or Share in the faid Stock, and in the pro- portional Annuity attending the fame at the Rate aforefaid, for the Monies fo by him, her or them ad- vanced; and that the faid Capital or Joint Srock, or any Share or Intereft therein, and the proportional Annuity attending the fame, fhall be affignable and transferable as this Act directs, and not otherwife; and that there fhall conftantly be kept at all feafonable Times in the Office of the faid Chief Accomptant for Transfer Book* ihe Time being, within the City of London, a Book or Books, wherein all Affignments or Transfers of the to be *"?'• faid Stock, or any Part thereof, and the proportional Annuity attending the fame, at the Rate aforefaid, fhall be entred and regiftred; which Entries fhall be conceived in proper Words for that Purpofe, and fhall be figned by the Parties making fuch Affignments or Transfers, or if fuch Party be abfent, by his, her or their Attorney, thereunto lawfully authorized by Writing under his, her or their Hands and Seals, to be attefted by two or more credible Witneffes, and that the Perfon or Perfons to whom fuch Transfer fhall be made do underwrite his, her or their Acceptance thereof; and that no other Method of affigning or transferring the faid Stock, and the Annuities attending the fame, or any Part thereof, or any Intereft therein, fhall be good or available in Law. IX. Provided always, That any Perfon or Perfons poffeffed of fuch Stock with the Annuity or Annui- Annuities may ties attending the fame, or any Eftate or Intereft therein, may devife the fame by Will in Writing, at- be devlfed - tefted by two or more credible Witneffes, but that fuch Devifee fhall receive no Payment thereupon, till fo much of the faid Will as relates to the faid Stock or Annuity be entred in the faid Office; and in De- fault of fuch Transfer or Devife, the faid Stock and Annuities attending the fame, fhall go to the Exe- cutors or Adminiftrators; and that no Stamp Duties whatfoever fhall be chargeable on the faid Tranf- No Stamps on fers, or any of them, any other Law or Statute to the contrary notwithftanding. Transfers. X. And it is hereby enacted and declared, That all Perfons who fhall accept any Affignment or Acceptors of Transfer of any Stock, from any Contributor who fhall have paid only Part of the Contribution-money ^"ck to pay for the fame, to the Ufe of the Publick, fhall be liable to pay the Refidue of the faid Contribution-money, Contribution. 5 and to fuch Forfeitures for Non payment thereof, as the original Contributor would have been liable if no fuch Transfer had been made. XI. Provided always, That no Perfon or Perfons whatfoever, fhall or may purchafe or obtain, or be Provifo. admitted to purchafe or obtain any of the Annuities at the Rate aforefaid upon this Act, unlefs the whole, or one fourth Part at leaft, of the Confideration Money for the fame, at fuch Rate as aforefaid, be ad- vanced and paid to the faid Cafhier on or before the fixth Day of July one thoufand feven hundred and forty -two, M m m 2 XII.
